Instant petition under Section 482 BNSS is filed seeking pre-arrest bail of the petitioner in connection with Bargarh Town P.S. Case No.235 dated 03.05.2026 corresponding to G.R. Case No.626 of 2026 pending in the Court of the learned S.D.J.M., Bargarh on the grounds stated. 3. Perused the FIR as at Annexure-1. Referring to Annexure-2 series, a copy of the bail order in respect of a co- accused, it is submitted that he has been released on the date of arrest itself after being forwarded and therefore, the petitioner should be extended parity. Recorded the objection of the State. Though a case under Section 109 BNS is registered, recording the claim that the petitioner does not have any antecedent and equally placed like the co-accused namely, Deepak Bhoi, this Court is inclined to grant the liberty to him to surrender and demand parity. 4. Accordingly, it is ordered. 5. In the result, the ABLAPL is disposed of with the direction as aforesaid. In the event, the petitioner surrenders before the court of learned SDJM, Bargarh within next three weeks from today in connection with G.R. Case No.626 of 2026 and moves an application for regular bail, it shall be duly considered by learned S.D.J.M. Bargarh during the first hour and in the event of rejection, he shall approach the learned Sessions Court for orders on the same day during second hours itself considering his demand for release on the ground of parity and in case found to be similarly situated, he shall be released on bail with conditions imposed. 6.
