According to the petitioner, there is electricity pole in front of his house, which is causing threat to the life and property of residents of the locality. Petitioner wants that electricity pole be shifted. 3. Petitioner has sought following relief in this writ petition: “Issue a writ, order or direction in the nature of mandamus District commanding the Magistrate/Collector, Udham Singh Nagar, to decide the petitioner's representation, submitted pursuant to the liberty granted by this Hon'ble Court vide order dated 24.08.2022 in Writ Petition (M/S) No. 1985 of 2022, within a time frame to be fixed by this Hon'ble Court, after affording due opportunity of hearing to all concerned.” 4. Learned State Counsel is right in submitting that instead of approaching District Magistrate, petitioner should have approached the competent authority in Uttarakhand Power Corporation Limited. 5. The writ petition is, accordingly, disposed of with liberty to petitioner to make representation to the Executive Engineer of the concerned Electricity Distribution Division. If petitioner makes representation within two 2026:UHC:300 weeks, decision thereupon shall be taken by Executive Engineer concerned within eight weeks thereafter. 6. Petitioner shall give an undertaking in the form of an affidavit before the Executive Engineer concerned that he is ready to deposit the amount required for shifting of the electricity pole as per the provisions of law or regulations framed by Uttarakhand Electricity Regulatory Commission.
