Instant petition under Section 482 BNSS is filed for pre-arrest bail of the petitioners in connection with Talcher P.S. Case No.55 of 2025 corresponding to G.R. Case No.118 of 2025 pending in the file of learned S.D.J.M., Talcher on the grounds stated therein. 3. Gone through the contents of the FIR as at Annexure-1. The petitioners belong to one family and they said to have committed overt acts, as alleged by the informant in the report. Learned counsel for the petitioners submits that the parties are in civil dispute, hence, the alleged incident took place. In so far as outraging modesty of the informant is concerned, it is claimed that the same has taken place in course of events during the incident. Recorded the objection of the State. This Court finds that petitioner Nos.1 & 2 are lady members of the family. It is further informed that petitioner No.3 is having one p. 2 criminal case of theft but petitioner No.4 does not have any antecedent, whereas, petitioner No.5 is an elderly person aged about 78 years. Considering the above facts and recording the objection of the State and in view of parties are known to each other and the alleged incident took place and during that time, excess was committed leading to disrobing of the informant, this Court though not inclined to grant pre-arrest bail to the petitioners, however, is of the view that they should be directed to surrender before the learned court below for being released with suitable conditions. 4. Accordingly, it is ordered. 5. In the result, ABLAPL is disposed of. It is further directed that in the event, the petitioners surrender within a fortnight from today before the learned S.D.J.M., Talcher in connection with Talcher P.S. Case No.55 of 2025 corresponding to G.R. Case No.118 of 2025, they shall be released on bail subject to them furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with one solvent surety for the like amount each to the satisfaction of the learned court below, which shall be at liberty to impose such other suitable conditions as deemed just and proper in the facts and circumstances of the case. 6.
