JUSTICE PRAVEER BHATNAGAR Order 29/01/2026 1. Apprehending his arrest in connection with FIR No.17/2024 registered at Police Station Gegal, District Ajmer for the offences under Sections 420, 406, 506 read with Section 120B of IPC, the accused-petitioners have preferred this criminal misc. bail application under Section 482 of B.N.S.S. 2. Learned counsel for the accused-petitioners submits that the accused-petitioner have falsely been implicated in this case under Sections 420, 406, 506 read with Section 120B of IPC. It is contended that police after investigation submitted negative final report, however, the concerned court took cognizance and instead of summoning petitioners directly summoned the petitioners through arrest warrants. The accused-petitioners are ready and [2026:RJ-JP:4219] (2 of 2) [CRLMB-15420/2025] willing to cooperate with the investigation and there are no criminal antecedents against the accused-petitioners, therefore, anticipatory bail application of the accused-petitioners may be allowed. 3. Learned Public Prosecutor has vehemently opposed the grant of anticipatory bail application. 4. Heard and perused the material available on the record. 5. It is not desirable to express anything on the merits of the case looking to fact that previously negative final report has been proposed and later on concerned court took cognizance against the accused-petitioners and summoned them through arrest warrants. The accused-petitioners are ready and willing to appear before the trial court and abide by the conditions, the court deems fit, therefore, this court deems it proper to direct the trial court that if petitioners appear before the court then petitioners shall be released on bail. 6. Accordingly, the anticipatory bail application under Section 482 of B.N.S.S. is allowed and it is ordered that the accused- petitioners namely 1.Mani Devi W/o Shri Mangu 2.Seema Rawat W/o Sanwara 3.Vijay S/o Shri Madan, appear before the concerned trial court then they shall be released on bail, provided they furnish a personal bond in the sum of Rs.50,000/- with two sureties in the sum of Rs.25,000/- each to the satisfaction of the concerned Magistrate.
