2. In the light of the limited relief sought for this Court is of the view that the writ petition can be disposed of dispensing notice to the respondent.
3. This writ petition is filed seeking a direction to the Court of Senior Civil Judge, Challakere to dispose of M.C.No.86/2022 which is pending on its file expeditiously.

Learned counsel for the petitioner submits that petitioner filed a petition under Section 13(1)(ia) of the Hindu Marriage Act against the respondent seeking a decree of divorce. He filed the petition in the year 2021 itself. The matter came up for cross-examination of PW1 in the year 2021 itself. However till now, the case is at the stage of cross-examination of PW1. There is no progress. Petitioner who resides at Tumkur is travelling all the way

HC-KAR NC: 2026:KHC:26335 WP No. 15431 of 2026 to Challakere on each and every date of hearing. Father of the petitioner suffers from cancer and petitioner is under obligation to take care of his father. As there is no progress in the case, the petitioner is constrained to file this writ petition seeking a direction for its expeditious disposal.
5. Certified copy of the proceeding sheets reveals that on 3.9.2021 the case was posted to 23.09.2021 for cross-examination of PW1. The order dated 09.04.2026 reveals that the matter was adjourned to 04.06.2026 for further cross-examination of PW1. No doubt in the interregnum, case was transferred from the Family Court, Tumkur in the year 2022. However, since 2022 till date the case is pending before the Court of Senior Civil Judge, Challakere without much progress. Hence, this Court is of the view that there is justification in the relief sought for. Therefore, the writ petition is disposed of with the following:

ORDER (i) The writ petition is allowed. (ii) The Court of Senior Civil Judge, Challakere is
directed to dispose of M.C.No.86/2022 pending on its file within a period of four months. (iii) In case the matter is required to be adjourned for any valid reason, reasons for adjournment shall be recorded in detail. (iv) Registry is directed to communicate the copy of this order to the concerned Court forthwith. (v) As the writ petition is disposed of without service of notice to the respondent, the Court of Senior Civil Judge, Challekere is directed to serve a copy of this order upon the respondent or her counsel who is representing before it.
