For Petitioner : Mr.D.Shanmugaraja Sethupathi For Respondents : Mr.S.Shanmugavel Additional Government Pleader O R D E R This petition has been filed seeking to direct the respondents to conduct survey of the land comprised in Survey No.24, Sub Division No.1A3, situated at Pulavanvayal Village within Kalayarkovil Taluk, in Sivagangai District within a time frame as may be fixed by this Court. 2. The learned counsel for the petitioner submitted that the property originally belonged to Ramanathan, who sold it to Ramprasath through a registered sale deed dated 21.05.2024, bearing Document No. 2466 of 2024 on the file of the Sub Registrar, Kalayarkovil, Sivagangai District. Subsequently, the 2/6 https://www.mhc.tn.gov.in/judis W.P.(MD)No.8502 of 2026 said Ramprasath conveyed the property to the petitioner by way of a registered sale deed dated 02.03.2026, registered as Document No. 1265 of 2026 on the file of the same Sub Registrar Office. He further submitted that Patta No. 1577 has been issued in favour of the petitioner, who is currently in possession and enjoyment of the property. In order to identify and demarcate the boundaries, the petitioner submitted an online application on 05.03.2026 after remitting the requisite fee. In these circumstances, the petitioner seeks a direction to the respondents to survey and demarcate the property. 3. Heard the learned Additional Government Pleader appearing for the respondents 1 to 3. 4. Considering the facts and circumstances of the case, this Court directs the 1st respondent to conduct the survey with assistance of the respondents 2 and 3 after issuing notice to the petitioner and the rival claimants, if any. If necessary, seek police protection, the Jurisdictional Police shall provide police protection to survey the land. The Court is also directing the Official respondents to adhere to 3/6 https://www.mhc.tn.gov.in/judis W.P.(MD)No.8502 of 2026 the following Standard Operating Procedures: a. The Official respondents shall issue notice to the petitioner immediately reaching the spot where survey is to be conducted. The petitioner shall affix the signature by receiving the notice of survey. b. After survey again the petitioner shall affix signature indicating that the survey was conducted to their satisfaction. c. If the petitioner is not satisfied, then also the petitioner shall affix signature indicating their dissatisfaction or with protest. The petitioner shall indicate that reason of their dissatisfaction or protest.
