The petitioners are apprehending their arrest in connection with Radhanagar P.S. Case No. 178 of 2021(s) registered under sections 304(b), 34 of the I.P.C, pending in the Court of learned Judicial Magistrate, Ist Class, Rajmahal. 3. Learned counsel for the petitioners submits that petitioners have earlier moved before this Court in A.B.A. No. 3945 of 2022 and by order dated 11.08.2022 the said anticipatory bail application was rejected. He next submits that again the petitioners moved before this Court in A.B.A. No. 4982 of 2025 which was also rejected by order dated 26.09.2025 and now on the fresh ground third anticipatory bail has been filed as husband has been acquitted. 4. Learned counsel for the State opposes the prayer and submits that there is no fresh ground and earlier twice anticipatory bail application of the petitioners has been rejected on merit and in view of that anticipatory bail of the petitioner may kindly be rejected. 5. It transpirres that twice anticipatory bail application of the ( 2026:JHHC:20658 ) petitioners has been rejected and this is third anticipatory bail application. Acquittal of co-accused cannot be sole ground to grant anticipatory bail. Reference may be made to the case of “Balmukund Singh Gautam Vs. State of M.P.” reported in 2026 SCC Online (SC) 205. 6. In the attending facts and circumstances of the case, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, their prayer for anticipatory bail is hereby rejected.
