The instant bail application has been preferred by the petitioners for grant of regular bail for the offences registered under Section 309(6) of the BNS in connection with S.T Case No. 155 of 2025 arising out of Madhupur PS Case No. 05 of 2025 and in this case, charges have been framed under Sections 310(2) and 317(2) of the BNS. 3. Learned counsel for the petitioners submits that the petitioners are innocent and have not committed any offence. He submits that the petitioners are not named in the FIR and no incriminating article has been recovered from the conscious possession of the petitioners. Learned counsel further submits that co-accused, namely, Rahul Sheikh @ Rahul Shekh in B.A No. 11036 of 2025 and Md. Siraj in B.A No. 3632 of 2025 have been granted bail by the Co-ordinate Bench of this Court vide order dated 05.12.2025 and 08.05.2025 respectively and the petitioners are in judicial custody since 16.01.2025 as such they may be enlarged on bail. 4. Learned APP opposes the prayer for bail of the petitioners. 5. Having regard to the allegation made against the petitioners coupled with the fact that co-accused in B.A No. 11036 of 2025 has been 2026:JHHC:6946 2 granted bail by the Co-ordinate Bench of this Court and the petitioners are in custody since 16.01.2025, I am inclined to enlarge the petitioners on bail. Accordingly, the petitioners, above-named, are directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand only) each with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I, Madhupur in connection with S.T Case No. 155 of 2025 arising out of Madhupur PS Case No. 05 of 2025. 6. It is made clear that the petitioners shall appear on each and every date before the learned trial Court and they shall not threaten any witness and shall co-operate in trial and if any adverse report will come against the above-named petitioners, learned trial Court shall be at liberty to cancel the bail of the above-named petitioners. 7.
