Mr. Badal Raj, District Superintendent of Education, Ranchi is also present. 3. This Contempt petition has been filed for initiating contempt proceedings against the opposite party no. 5 alleging intentional and deliberate disobedience of the order and judgment dated 27.04.2022 passed by this Court in W.P.(S) No. 7065 of 2013. 4. A supplementary show-cause has been filed before this Court during the court proceedings, which is taken on record. 5. Learned counsel for the opposite parties has submitted that as per the supplementary show-cause, the differential amount of Rs. 4768/- payable on account of unutilized Earned Leave has been 2 credited to the account of the petitioner and so far as re-fixation of pension as well as gratuity is concerned, the matter has now been forwarded to the office of Accountant General, Jharkhand, Ranchi with the original service book and other connected records vide Memo No. 2610 dated 11.07.2026 for taking necessary action in accordance with law. The learned counsel for the opposite parties has also submitted that once there is clearance from the Accountant General, Jharkhand, Ranchi, needful will be done by the treasury office. The learned counsel has submitted that though there has been some delay, but whatever could have been done on the part of District Superintendent of Education, Ranchi, has already been done. 6. So far as filing of affidavit in terms of order dated 12.06.2026 is concerned, the learned counsel for the opposite parties has submitted that it was affidavited but it could not be filed in time. 7. Learned counsel for the petitioner has submitted that the petitioner is 72 years of age and he is not sure as to what action will be ultimately taken by the office of Accountant General, Jharkhand, Ranchi. He has further submitted that the matter may be kept pending and the office of Accountant General, Jharkhand, Ranchi may be permitted to make party in the present proceedings. 8. However, it is not in dispute that the office of Accountant General, Jharkhand, Ranchi was not a party in the writ petition and no direction as such was issued to the office of Accountant General. 9. At this, learned counsel for the petitioner has submitted that paragraphs 8, 9 and 10 of the supplementary show-cause be quoted so that it will be convenient for the petitioner to proceed as per law. 10. Paragraphs 8, 9 and 10 of the supplementary show-cause are quoted as under: “8. That it is further humbly stated and submitted that pursuant to the judgment passed by this Hon'ble Court and in furtherance of the decision of the District Education Establishment Committee, the concerned Drawing and Disbursing Officer prepared Bill No. 18 dated 11.07.2026 for a sum of Rs. 4,768/- towards the differential amount payable on account of unutilized Earned Leave. The said amount has already been disbursed to the petitioner through her Savings 3 Bank Account No. 10923687080, State Bank of India, Doranda Branch. 9. That it is further humbly stated and submitted that in continuation of the compliance of the judgment passed by this Hon'ble Court, the proposal for refixation of pension as well as gratuity of the petitioner has already been forwarded to the Accountant General, Jharkhand, Ranchi, along with the original Service Book and other connected records vide Memo No. 2610 dated 11.07.2026 for taking necessary action in accordance with law. 10. That it is respectfully submitted that upon receipt of the aforesaid proposal, the office of the Accountant General, Jharkhand, Ranchi shall undertake the statutory exercise for revision of the petitioner's pensionary benefits on the basis of the revised pay fixation. The modified Pension Payment Order (PPO) shall thereafter be issued in favour of the petitioner. The petitioner shall also become entitled to payment of the revised gratuity amount of Rs. 32,946/- besides such consequential arrears of pension and gratuity as may be determined by the Accountant General which shall thereafter be released to the petitioner through her designated bank account.” 11. After hearing the learned counsels for the parties and considering the fact that the needful has already been done by the office of the District Superintendent of Education, Ranchi and now the matter is pending before the Accountant General, Jharkhand, Ranchi, this Court is not inclined to proceed any further in this contempt proceedings, which is hereby dropped. 12. Liberty is reserved with the petitioner to take steps as per law, if the surviving grievance of the petitioner is not redressed. 13.
