The Court made the following: ::ORDER::
Heard Sri T. Ashok Srivastava, learned counsel for the petitioner; Sri P.Rajesh Kumar, learned Assistant Government Pleader for Panchayat Raj and Rural Development, for respondents 1 and 4; Ms. P. Usha, learned Assistant Government Pleader for Revenue, for respondents 2 and 3, and Ms. Kavitha, learned counsel representing Sri M. Sudhir, learned standing counsel for respondents 5 and 6. 2.
Learned counsel for the petitioner would submit that the petitioner is the absolute owner and possessor of Ac.0.03.966 cents in survey No.225/A (wrongly typed as survey No.255/A, in the writ affidavit), Bheemavaram Village, Nandyal Mandal and District, having purchased the same under registered document bearing No.12636/2020 dated 17.12.2020. Respondents 2 to 6, without following the due process of law, are attempting to construct an underground water storage tank on the petitioner’s land. The petitioner immediately got issued a legal notice, Ex.P4.
3. Ms. Usha, learned Assistant Government Pleader for Revenue, submitted the instructions furnished by the Tahsildar-respondent No.3.

As seen from the instructions, the authority is not interfering with the land in survey No.225/A (wrongly typed as survey No.255/A, in the affidavit), Bheemavaram Village, Nandyal Mandal and District. In fact, one Pothireddy Pullareddy has voluntarily donated the land of an extent of Ac.0.03 cents in survey No.265/1, for public purpose. The land claimed by the petitioner and the land donated are distinct and different. No attempt was made to construct a water storage pump in the petitioner’s land.
5. Ms. Kavitha, learned counsel for respondents 5 and 6 submitted the instructions of respondent No.5. A perusal of which would disclose that the Gram Panchayat has neither passed any resolution nor allotted any land in this regard.
6. Thus, as seen from the instructions of respondents 3 and 5, neither respondent No.3 nor respondent No.6 is interfering with land measuring Ac 0.03.966 cents in survey No.225/A (wrongly typed as survey No.255/A, in the affidavit), Bheemavaram Village, Nandyal Mandal and District.
7. Given the facts and circumstances of the case, this writ petition is
disposed of at the admission stage, with consent on either side, directing respondents 3 and 6 not to interfere with land of an Ac.0.03.966 cents in survey No.225/A (wrongly typed as survey No.255/A, in the affidavit), Bheemavaram Village, Nandyal Mandal and District, without following due process of law. No costs.
As a sequel, pending miscellaneous petitions, if any, shall stand closed.
