For Petitioner : Mr.B.Prahalad Ravi For Respondent-1 : Mr.A.Albert James Govt.Advocate(Crl.side) 1/5 https://www.mhc.tn.gov.in/judis O R D E R The present Petition has been filed by the second accused in Crime No.17 of 2024, on the file of the first respondent-Police seeking to quash the FIR, wherein, the Petitioner is alleged to have committed the offence under Sections 417 and 420 of IPC. 2.A perusal of the records reveal that the defacto complainant is said to have advanced a sum of Rs.1,10,00,000/-for supply of electronic goods.The Petitioner, his brother and one of the partners have misappropriated the said amount and the electronic goods were not supplied. 3.The learned counsel for the Petitioner submitted that he is not a partner and the Petitioner is no way associated with the business of his brother. In case, if the electronic goods are not supplied, A1 alone is reponsible for the same and not the Petitioner. 4.Heard the learned counsel appearing on either side and perused the materials placed before this Court. 5.A perusal of the FIR reveals that there are specific overtact against the Petitioner. In such circumstances, this Court is not 2/5 https://www.mhc.tn.gov.in/judis inclined to quash the FIR, especially, when there is no legal ground made out. 6.The learned Government Advocate(Crl.Side) appearing for the first respondent-Police submitted that charge sheet has been laid before the learned Judicial Magistrate No.II, Pudukkottai on 26.03.2026. In such circumstanes, there are no merits in the Criminal Original Petition and accordingly, the same stands dismissed.
