For Respondent(s) : Mr. Manvendra Singh, PP with Mr. Anirudh Singh, Astt. Adv.
HON'BLE MR. JUSTICE PRAVEER BHATNAGAR
Order 27/01/2026
1. The instant bail application has been filed under Section 483 of B.N.S.S. on behalf of accused-petitioner. The accused-petitioner has been arrested in connection with FIR No.113/2025, registered at Police Station Kaithwara, District Deeg, for the offence(s) under Sections 115(2), 126(2), 103(1), 352 and 333 of BNS.
2.
Learned counsel for the petitioner submits that the accused- petitioner has falsely been implicated in the present case. It is contended that there is no specific attribution against the petitioner regarding causing injury at the stomach of the deceased. It is further contended that as per the charge-sheet, the Investigating Officer has concluded that an altercation took place between the deceased, petitioner and the other co-accused, during which the deceased fell upon a wooden peg, resulting in an
[2026:RJ-JP:3527] (2 of 3) [CRLMB-15271/2025] injury at his liver. It is further contended that the injury found on the head of the deceased was an incised wound without any skull injury. As per the post-mortem report, the cause of death is stated to be hemorrhagic shock due to laceration of liver right lobe wound. There is no specific allegation or attribution that the petitioner inflicted any injury to the stomach of the deceased. It is argued that the co-accused Kamla has already been enlarged on bail by the Co-ordinate Bench of this Court vide order dated
16.10.2025. It is further argued that the accused-petitioner is in custody since 19.06.2025 and further trial of the case may take considerable time, therefore, the bail application of the accused- petitioner may be allowed.
3.
Learned counsel for the petitioner has submitted a copy of the charge-sheet, the same is taken on record.
4. Learned Public Prosecutor has vehemently opposed the grant of the bail application and contended that the petitioner along with the other co-accused, caused injuries to the deceased, who succumbed to the injury to his liver. Therefore, considering the aforesaid facts, the bail application filed on behalf of the accused- petitioner may be dismissed.
5. Heard and perused the material available on the record.
6. Considering the arguments advanced by learned counsel for the petitioner and after going through the conclusion recorded by the Investigating Officer at Point No.3 of the charge-sheet coupled with Post-mortem report of the deceased, without commenting anything on the merits of the case, this Court deems it proper to enlarge the accused-petitioner on bail.
[2026:RJ-JP:3527] (3 of 3) [CRLMB-15271/2025]
7. Accordingly, the bail application under Section 483 of B.N.S.S. is allowed and it is ordered that the accused-petitioner- Omprakash @ Amilal S/o Bhairelal, in connection with FIR No.113/2025, registered at Police Station Kaithwara, District Deeg, shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the Court concerned on all the dates of hearing and as and when called upon to do so.
