-1- 19-APPLN-3972-2026 IN THE HIGH COURT OF JUDICATURE AT BOMBAY BENCH AT AURANGABAD CRIMINAL APPLICATION NO. 3972 OF 2026 IN WP/590/2026 SEEMA ARVIND PATIL VERSUS ARVIND SHRIPATRAO PATIL ...... Advocate for Applicant : Mr. Shailendra S. Gangakhedkar Advocate for Respondent : Mr. Gaurav L. Deshpande WITH CRIMINAL WRIT PETITION NO. 590 OF 2026 ...... CORAM : HITEN S. VENEGAVKAR, J. DATED : 12th OCTOBER, 2026 PER COURT : CRIMINAL APPLICATION NO. 3972 OF 2026 : 1. Heard the learned Advocate appearing for the applicant – wife and learned Advocate for the respondent-husband/original petitioner. 2. The present original proceeding arises out of the order granting interim maintenance to the present applicant. Though the original order has been impugned on several other grounds, the contention of the present applicant in the present application is restricted only for the purpose of withdrawal of the amount that has been deposited by the husband in pursuance of the orders passed by this Court. 3. It is stated that, during pendency of the original writ -2- 19-APPLN-3972-2026 petition, the husband has deposited Rs.2,56,000/- in this Court to show his bona fide. On the compliance of which the ad-interim order has been passed in his favor, staying the further proceedings of interim maintenance before the Trial Court. 4. The learned Advocate appearing for the respondent - husband though contests the application of withdrawal on various grounds, I am inclined to allow the application for the reason that the amount of interim maintenance granted in favour of the present applicant is Rs.18,000/- per month. The applicant has made out a ground that she has to maintain herself along with her son, who is taking education for which necessary expenses are required to be incurred. 5. Without going into the merits of the case and without prejudice to the contentions raised by the husband in his original proceedings as well as in the writ petition, the application stands allowed in terms of prayer clause B. 6. The applicant is permitted to make an appropriate application to the Registry of this Court seeking withdrawal of the amount of Rs.2,56,000/-. Upon receipt of the application, the Registry shall hand over the amount along with accrued interest thereon, if any, to the applicant. 7. Needless to say that this is without any prejudice to the rights and contention of either party. 8. The application stands disposed of. -3- 19-APPLN-3972-2026 CRIMINAL WRIT PETITION NO. 590 OF 2026 : 9. List the Writ Petition on 20.11.2026. 10. Interim relief, if any, to continue till the next date. (HITEN S. VENEGAVKAR) JUDGE Tandale
