2026:JHHC:19794 1 IN THE HIGH COURT OF JHARKHAND AT RANCHI W.P.(C) No.4706 of 2026 ------ Ajit Kumar Gorai, son of Late Haripada Gorai, resident of Jaynagar Road, P.O., P.S. & District Koderma. … … Petitioner Versus 1. The State of Jharkhand. 2. Deputy Commissioner, Koderma, P.O., P.S. & District Koderma. 3. Sub-Divisional Officer, Koderma, P.O., P.S. & District Koderma. 4. Circle Officer, Koderma, P.O., P.S. & District Koderma. 5. Smt. Poonam Devi, wife of Rajkumar Burnwal, resident of Jaynagar Road, Koderma Bazaar, P.O., P.S. & District Koderma. … … Respondents ------ CORAM : SRI ANANDA SEN, J. ------ For the Petitioner : Mr. Ashim Kr. Sahani, Advocate For the Respondent : Mr. Anil Kumar Singh, AC to GP-I ------ 02/ 06.07.2026 By filing this writ petition, the petitioner has prayed for the following reliefs :- “for grant of an appropriate writ in the nature of mandamus, or an order of direction commanding upon the respondents, more particularly the respondent no.2, to consider and pass appropriate orders on the representation dated 19/12/2025 filed by the petitioner, within a reasonable period, and for any other appropriate writ or order or direction as this Hon’ble Court may deem fit and proper.” 2. Heard learned counsel representing the petitioner and learned counsel representing the respondents. 3. After going through the petition, I find that no relief can be granted to the petitioner in this case as because any representation filed by an individual person before an Authority need not be considered, if the Authority is not vested with the statutory power or obligation to decide the representation so filed. 2026:JHHC:19794 2 4. The dispute in this case is between the petitioner and respondent No.5 (private respondent) in relation to land and boundary and the right of ingress and egress. In a proceeding under Section 144 of the Indian Penal Code, the Executive Court has rightly directed both the parties to approach the Civil Court. There is no scope of filing any representation before any Revenue Authority or Executive Authority. 5. The petitioner thus should approach the Civil Court and pray for an appropriate relief as per the provision of the Code of Civil Procedure. 6. With the aforesaid observation, this writ petition stands disposed of. (ANANDA SEN, J.) 06th July, 2026 Prashant. Cp-2 Uploaded on 14.07.2026
