This first anticipatory bail application under Section 482 of the Bhartiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicants, who are apprehending their arrest in connection with Crime No. 609/2025 registered at Police Station – City Kotwali, District - Durg, (C.G.) for the offences punishable under Sections 221, 126(2), 191(2), 121(1), 132, 61(2), 125(a) of Bharatiya Nyaya Sanhita, 2023. 2. As per the prosecution’s case, on the report lodged by Constable Kamalkat Angoore posted at Police Station City Kotwali, Durg, it was alleged that on 01.12.2025, the complainant was deployed on line order duty in front of Patel Chowk, BSNL Office, Durg along with police force from City Kotwali and other police stations. It was alleged that on the said date, the present Applicants along with other co-accused persons including Manoj Rajput, Anil Kumar Vasnik, Rakesh Yadav, Vicky Chandrakar, Jitendra Batra, Geeteshand and others, were protesting against the increase in the price of 3 land registration and without any prior permission or intimation to the authorities, allegedly blocked the public road in front of the BSNL Office, thereby causing traffic congestion and obstruction to public movement. It was further alleged that despite repeated advices and persuasion by the police personnel present on duty, the present Applicants along with the other co-accused persons turned violent, indulged in a scuffle with the police staff and obstructed them from discharging their official duties. It was also alleged that due to the said incident, police personnel namely Head Constable Radheshyam Chandrakar No. 1614, Constable Keshav Kumar No. 84, Constable Tushar Salame No. 34, Constable Ajay Sahu No. 827 and Constable Himanshu Janghel No. 1077 sustained injuries. On the basis of the aforesaid report, FIR No.609/2025 was registered at Police Station City Kotwali, Durg, District Durg, initially the offences under Sections 221, 126(2) and 191(2) of the Bharatiya Nyaya Sanhita, 2023 were registered and during the investigation, offences under Sections 121(1), 132, 61(2) and 125(a) of Bharatiya Nyaya Sanhita, 2023 were subsequently added. Hence, this anticipatory bail application has been filed. 3. Learned counsel for the applicants submits that the applicants are innocent and have been falsely implicated in the present 4 case. He further submits that the police had already taken preventive action against the applicants and other protesters and had placed the matter before the Sub-Divisional Magistrate, Durg (City), District Durg in Istegasa No.209/536/2025 pursuant to which, they have been released from the custody on execution of a bond. He further submits that this Court, in MCRCA No. 2003 of 2025, vide order dated 07.01.2026, has been pleased to grant anticipatory bail to one of the co-accused namely Manoj Rajput, who has been implicated on the same set of allegations, same FIR and same transaction as the present Applicants; therefore, on the well-settled principle of parity, fairness and equal treatment, the present Applicants are also entitled to the benefit of anticipatory bail, therefore, the present applicants may also be granted anticipatory bail on the grounds of parity. 4. On the other hand, learned State Counsel opposes the submissions advanced on behalf of the applicants and submitted that even after repeated advices and persuasion by the police personnel present on duty, the present applicants turned violent and also caused injuries to the police personnel, which is a very serious offence and therefore, they are not entitled for grant of anticipatory bail. 5 5. I have heard learned counsel for the parties and perused the case diary. 6. Taking into consideration the facts and circumstances of the case, submissions of learned Counsel for the parties and material available on record and further considering that this Court, in MCRCA No. 2003 of 2025, vide order dated 07.01.2026, has granted anticipatory bail to one of the co- accused namely Manoj Rajput, I am inclined to grant anticipatory bail to the present applicants on the ground of parity. 7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicants – Shubham Singh, Omprakash Kotwani and Jaswant Singh Rajput, on executing a personal bond and one surety each in the like sum to the satisfaction of the arresting Officer, they shall be released on bail on the following conditions:- (a) The applicant/s shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/them from disclosing such fact to the Court. (b) The applicant/s shall not act in any manner which will be prejudicial to fair and expeditious trial. 6 (c) The applicant/s shall appear before the trial Court on each and every date given to him/them by the said Court till disposal of the trial. (d) The applicant/s and the surety shall submit a copy of his adhaar card along with a coloured postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.
