1. Applicants have filed this bail application under Section 483 of Bhartiya Nagrik Suraksha Sanhita, 2023 for grant of regular bail as they have been arrested in connection with Crime No. 24 of 2024 registered at Police Station –Singhoda, District- Mahasamund (C.G.) for offence punishable under Section 20 (b)of the NDPS Act. 2. Case of prosecution in brief is that on 16.03.2024, one Desire white coloured car bearing registration No. OD 02 CG 2298 was intercepted by police and upon search recovered 114 kg of contraband (ganja) and thereafter crime was registered, contraband was seized and applicants were arrested.

Learned counsel for applicants submits that applicants have been falsely implicated in the crime. They have not committed any crime as alleged against them. They are in jail since 16.03.2024, hence, they may be enlarged on bail. He also submits that according to his instructions, since last about 2 years, only one witness is examined out of 16.
4. On the other hand, learned State counsel vehemently opposes the submission made by learned counsel for the applicants and submits that upon search of Car, police seized huge quantity of contraband (ganja) of 114 kg and applicants are residents of Odisha.
5. I have heard learned counsel for the parties and perused the documents enclosed along with bail application.

Considering the submissions made by learned counsel for the respective parties, facts and circumstances of the case, considering that police seized 114 kg of contraband (ganja) from car in which applicants were found travelling at the time of search, I do not find present to be a fit case to enlarge the applicants on bail.
7. The application is accordingly rejected. However, considering the period of detention of applicants since 16.03.2024, trial Court is directed to expedite the trial and take all necessary measures as provided under
3 / 3 BNSS for causing presence of witnesses to conclude the trial at the earliest.
8. Registry is directed to send copy of this order to the concerned trial Court for action and compliance.
