HEMALEKHA ORAL ORDER The petitioner has approached this Court seeking for the following prayers: ") Issue a writ in the nature of certiorari quashing/setting aside the letter dated:25-06-2025 bearing SaKaNi/Pa4/SaTa(o)/2025-26/651 issued by 3rd Respondent produced herewith as Annexure-J. ii) Issue a writ in the nature of Mandamus, directing the 3rd respondent to provide permanent power supply by converting the temporary connection into permanent and iii) Pass such other orders/directions as this Hon'ble Court may deem fit in the facts and circumstances of the case, in the interest of justice and equity." 2. The petitioner claims to be the owner of the residential property bearing old No.14, then 19, thereafter No.14, now Municipal No.5/4, PID No.78-95-5/4 situated at 9th Cross, Vasanthanagar, BBMP Ward No.78, Bengaluru (for short 'schedule property'). The respondent - BBMP issued a provisional order dated 26.08.2024 (Annexure-F) - 4 - HC-KAR NC: 2026:KHC:12786 WP No. 19121 of 2025 directing the Zonal Commissioner to demolish the building constructed by the petitioner. Subsequently, on 10.09.2024 (Annexure-G) a confirmation order came to be passed directing the petitioner to demolish the said construction, failing which the authorities would proceed to demolish the same. 3. Aggrieved by the same, the petitioner has preferred W.P.No.7516/2025 and this Court vide order dated 14.03.2025 has granted an interim order staying the order of demolition. 4. Learned counsel for the petitioner submits that a temporary electricity connection has already been provided to the schedule property and since the demolition proceedings are pending consideration in W.P.No.7516/2025, the present petition may be disposed of subject to the final outcome of W.P.No.7516/2025. 5. Learned counsel appearing for respondent Nos.2 and 3 submits that she has no objection on the said aspect. - 5 - HC-KAR NC: 2026:KHC:12786 WP No. 19121 of 2025 6. Having regard to the submissions made above and taking note of the fact that the demolition order passed by BBMP is already the subject matter of challenge in W.P.No.7516/2025, which an interim order of stay is in operation, it would be appropriate to dispose of the present writ petition by making the electricity connection subject to final outcome of the said proceedings. Accordingly, this Court pass the following: ORDER i) The writ petition is disposed of. ii) It is needless to state that the connection provided to the schedule property by respondent Nos.2 and 3 should be subject to the final outcome of W.P.No.7516/2025.
