KAMAL ORAL ORDER Petitioner, the mother of the deceased had lodged a complaint on 22.12.2022 which came to be registered in Crime No.326/2022 for the offences punishable under Sections 143, 147, 149, 302, 447, 427, 504 and 506 of the Indian Penal Code. Being aggrieved by the slow pace of investigation, present petition is filed seeking following reliefs: (i) ISSUE a writ of mandamus or any other writ or direction directing to entrust Crime No.0326/2022 on the file of Sathanoor Police Station, Kanakapura Circle, Ramanagara District to either CID or any other higher grade - 3 - HC-KAR NC: 2026:KHC:26865 WP No. 5295 of 2023 investigating agency to conduct investigation and to proceed with the accused persons in accordance with law to meet the ends of justice. (ii) ISSUE, a writ of mandamus or any other writ or direction directing the respondents to expedite the investigation in Crime Nos.0213/2022 & 0290/2022 on the file of Sathanoor Police Station, Sathanoor, Kanakapura taluk, Ramanagara District. (iii) ISSUE, a writ of mandamus or any other writ or direction directing the respondents to consider the representations dated 16.1.2023, 1.2.2023 & 22.2.2023 copies of which are produced at Annexures-G, H & J respectively and to dispose of the same in accordance with law to meet the ends of justice. (iv) GRANT such other order or direction as deems fit to grant in the facts and circumstances of the case. 2. Learned counsel for the petitioner submits that petitioner is primarily aggrieved with regard to investigation in Crime No.326/2022 and petitioner would not press as regard to Crime Nos.213/2022 and 290/2022. - 4 - HC-KAR NC: 2026:KHC:26865 WP No. 5295 of 2023 3. Learned counsel for the petitioner now submits that after filing of the Writ Petition, a final report has been filed on 06.03.2023 . However, he submits that investigation as against accused Nos. 1, 5, 6, 7, 8, 9 and 10 has not been completed and there is no progress in the matter. He points out to the note found at the end of the final report in terms of which the Investigation Officer has sought for time for further investigation and to submit the report under Section 173(8) of Criminal Procedure Code. It is his submission that despite the charge sheet having been filed on 06.03.2023, till date there has been no progress. 4. Heard. Perused the records. 5. Since the final report has already been filed, petitioner is always entitled to seek such remedy as may be available before the concerned Magistrate before whom charge sheet is filed, who is empowered under the provisions of Criminal Procedure Code now Bharatiya Nagarik Suraksha Sanhita, 2023 for order further investigation or seek such information from the Investigation Officer as may be - 5 - HC-KAR NC: 2026:KHC:26865 WP No. 5295 of 2023 required. Since no other grounds are urged, this Court does not see any reason to interfere at this juncture. 6.
