By way of the present writ petition, the petitioner has sought appropriate directions in relation to allotment and retention of government accommodation, as well as against the action of sealing/cancellation of the allotted quarter. 2. The brief facts of the case are that the petitioner is a government employee and was earlier allotted official accommodation. It is stated that the petitioner has been posted at Police Outpost Podi Bachra, District Baikunthpur (Korea), however, the petitioner is stated to be retaining accommodation at Baikunthpur. It is further submitted that on account of the said circumstances, proceedings have been initiated for cancellation/sealing of the said quarter. 3. Learned State counsel submits that the petitioner has been posted at Podi Bachra Outpost, District Baikunthpur (Korea), and therefore, as per applicable rules, the petitioner is entitled to accommodation at the place of posting only. It is submitted that the action of cancellation/sealing of the quarter is in accordance with law. 4. Per contra, learned counsel for the petitioner submits that the petitioner is ready and willing to vacate the present accommodation, provided that suitable government quarter is 3 allotted at her place of posting. It is submitted that once accommodation is provided at Podi Bachra, the petitioner shall vacate the existing quarter. 5. Having considered the submissions advanced by learned counsel for the parties, this Court finds that the petitioner’s grievance essentially relates to non-availability of suitable residential accommodation at the place of posting. The petitioner has fairly submitted that she is willing to vacate the present quarter once alternative accommodation is provided at her place of posting. The State, on the other hand, has submitted that allotment is governed by posting and applicable rules. 6. In view of the aforesaid submissions and without entering into the merits of the dispute, the competent respondent authorities as well as the Superintendent of Police concerned are directed to consider the case of the petitioner sympathetically and in accordance with rules, and to provide suitable residential accommodation at the petitioner’s place of posting, i.e., Podi Bachra Outpost, District Baikunthpur (Korea), at the earliest. 7. It is further directed that till suitable accommodation is allotted to the petitioner at the place of posting, no coercive action shall be taken against the petitioner for vacation of the existing quarter. 4 8. The concerned authorities are also directed to open the sealed quarter and hand over the same to the petitioner in accordance with law, subject to completion of necessary formalities. 9. It is made clear that upon allotment of appropriate accommodation at the place of posting, the petitioner shall vacate the present quarter without delay. 10. It is further clarified that in case it is found that the accommodation is misused or utilized for any commercial activity or subletting, the authorities shall be at liberty to take appropriate action in accordance with law. 11.
