Heard Mr. Ritesh Sharma, learned counsel for the petitioner as well as Mr. Nitansh Jaiswal, learned Deputy Government Advocate, appearing for the State/respondent No.1. 2. The present petition has been filed by the petitioners under Section 528 of the Bhartiya Nagrik Suraksha Sanhita with the following prayers :- “i. This Hon'ble Court may kindly be pleased to quash/set-aside the impugned first information report (F.I.R.) No. 253/2026 registered at Police Station ROHIT KUMAR CHANDRA Digitally signed by ROHIT KUMAR CHANDRA 2 Sarkanda, Bilaspur District-Bilaspur (C.G.) dated 25/02/2026 for offences under section 69 of the Bharatiya Nyaya Sanhita, 2023, in the interest of justice. ii. This Hon'ble Court may kindly be pleased to quash/set-aside the Chargesheet No. 191/2026 dated 11/03/2026 filed under section 69 of the Bharatiya Nyaya Sanhita 2023, against the present applicant, in the interest of justice. iii. This Hon'ble Court may kindly be pleased to quash/set-aside the entire criminal proceedings of the session case no. 90/2026 (state of C.G. v/s Suresh Kumar Sahu pending before the additional session judge Bilaspur District-Bilaspur (C.G). in the interest of justice.” 3. From perusal of the prayers and pleadings made in the instant petition, it transpires that though the petitioners have prayed for quashing of the charge-sheet as well as the entire criminal proceedings but, have neither challenged the order taking cognizance nor have mentioned the date of order taking cognizance, which goes to show that the prayer drafted by learned counsel for the petitioner is in a very casual manner and further wasted the precious time of the Court, as such, in the opinion of this Court, the prayer is defective one. 4. Accordingly, the instant petition is dismissed on this ground alone with liberty to file afresh petition with appropriate prayer, subject to depositing a sum of Rs.2,000/- as cost by the petitioner before the Registry of this Court and submit a receipt of the same at the time 3 of filing of the fresh petition, if any, and the amount so deposited, if any, shall be transmitted to the Government Multi-Disabled Home, Village Pendri, District – Janjgir-Champa (C.G.).
