Notice to respondents is dispensed with, in view of the proposed order to be passed. 2. Petitioner is before this court seeking for the following reliefs: - 3 - HC-KAR NC: 2026:KHC:25932 WP No. 12004 of 2026 i) Issue a writ in the nature of certiorari or any other appropriate writ or direction setting aside the order dated 08.03.2025 passed by Lok Adalat, at Bengaluru (CCH-83), in Ex.No.25482/2023, accepting the joint memo filed by the parties and ordering compliance on the terms of the joint memo to be reported, produced as Annexure-A. ii) Grant such other relief/s as this Hon'ble Court may deem fit in the circumstances of the case. 3. The contention of Sri.Likhith, learned counsel appearing on behalf of Sri.Srinivas.S.V., learned counsel for the petitioner is that the petitioner had signed a joint memo before the Lok-Adalath on the basis of certain promises held out by the decree holder. The petitioner, not knowing English has affixed her signature without understanding what has been stated in the said joint memo. 4. I am unable to agree or accept to the said submission, for the simple reason, that the joint memo has been signed in English by the petitioner. 5. The present petition and the verifying affidavit, which are in English has also been signed by the petitioner - 4 - HC-KAR NC: 2026:KHC:25932 WP No. 12004 of 2026 in English. The Vakalathnama has also been signed in English by the petitioner and at none of the places, is it mentioned that the petitioner does not know English and has been explained in a language known to her. The signature, which is found in the Verifying Affidavit, Joint Memo and Vakalathnama indicates that the signature is made in a proper manner in the English language. 6. Once a person has signed a Joint Memo before the Lok-Adalath and the said Joint Memo has been accepted and acted upon, the petitioner, a signatory to the said Joint Memo cannot now contend otherwise that he or she was not aware of the language, in which, the Joint Memo has been written. 7. If such a submission were to be accepted, there would be no sanctity to any settlement arrived at before the Lok-Adalath. - 5 - HC-KAR NC: 2026:KHC:25932 WP No. 12004 of 2026 8.
