GP FOR REVENUE The Court made the following: ORDER: The Writ Petition has been filed for the following relief: “…to issue a Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus, declaring the action of the respondents, especially Respondent Nos. 3 and 4, in interfering with the petitioner's peaceful possession and enjoyment of his house site, and in illegally threatening, summoning and detaining the petitioner and his family members in connection with a purely civil dispute, as illegal, arbitrary, unconstitutional and violative of Articles 14, 21 and 300-A of the Constitution of India, and consequently direct the respondents not to interfere with the peaceful possession and enjoyment of the petitioner's house site except in accordance with due process of law not to harass, threaten, summon or detain the petitioner and his family members in relation to the said civil dispute, and pass…” 2. Heard the learned counsel for Petitioner and learned Assistant Government Pleader. 3. Mr. V. R. Maheswara Rao Paleti, learned counsel for the Petitioner, submits that Respondent Nos. 3 and 4 are interfering with the Petitioner’s peaceful possession and enjoyment of his house site and are threatening the Petitioner and his family members. 4. Sri P. Ajay Babu, learned Assistant Government Pleader, submits that the respondents have never interfered with the peaceful possession and enjoyment of the Petitioner and his family members, nor compelled the Petitioner to attend the police station without any cause. 5. Considering the facts and circumstances of the case, and upon recording the submissions of the learned Assistant Government Pleader, the Writ Petition is disposed of with a direction to Respondent Nos. 3 and 4 not to 3 interfere in the civil dispute of the Petitioner henceforth, except in accordance with due process of law. 6. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs. As a sequel, Miscellaneous petitions, if any pending, shall stand closed. _________________________ DR. Y.
