Hon'ble Shri Justice Parth Prateem Sahu Order On Board 28/01/2026 1. Claim of the petitioners in the present writ petition is for a direction to the respondents to consider their claim for grant of regular pay scale of Rs. 2550-3200 after completion of three years of service under the respondents in terms of the circular of the State Government dated 10.05.1984. According to the petitioners, they were appointed in the year 1981 & 1982 and as such completed three years of continuous service in between 1984 and 1985. The contention of the petitioners is that in terms of the circular of the State Government dated 10.05.1984, they would had been entitled for regular scale of pay on completion of three years of service, which in the instant case has not been granted and petitioners’ services were initially regularized under the contingency rules in the year 2008 under respondent/State. Petitioners have now come before this Court for issuance of appropriate directions to the respondents authorities to consider and grant regular pay scale on completion of three years of service from their initial date of appointment. Learned counsel for petitioners have referred two 3 orders dated 19.07.2017 passed in WPS No. 3155 of 2017 and order dated 21.07.2010 passed by this Court in WPS No. 3510 of 2010. The aforesaid two petitions filed earlier were disposed off with direction to consider claim of petitioner therein. 2. Learned counsel for State would submit that the claim of the petitioners’ shall be examined on the basis of applicable circulars and rules issued by the State Government from time to time for grant of pay scale to daily wages employees working under the State Government, including such circulars, if any, made applicable to the Public works Department. 3. On due consideration on the submission of learned counsel for respective parties, instead of keeping this petition pending seeking reply from the respondents I find it appropriate to dispose of this writ petition at this stage directing respondents No. 2 and 4 to examine the claim of petitioners under applicable government circulars and take decision thereon within a period of three months from the date of receipt of copy of this order. The Claim of the petitioners shall be considered strictly in accordance with rule and regulation and the Government instructions governing the field and claim of the petitioners also shall be decided after due verification of the status of petitioners at the time of their initial appointment. 4. With the aforesaid observation and directions, this writ petition stands disposed off. Sd/- (Parth Prateem Sahu) Judge Balram
