property was owned by MGF, but appropriate evidence in that regard is being collected. 4. In the above circumstances, learned APP for State, on instructions of IO, submits that presently, the investigation is at nascent stage and the IO is yet to collect sufficient evidence on the basis whereof the accused/applicant can be arrested. That being so, learned APP for State submits that as and when the IO is able to collect sufficient evidence to arrest the accused/applicant, he shall issue a written notice to the accused/applicant granting him at least ten days to apply afresh for anticipatory bail. 5. In view of the above statement of learned prosecutor, learned counsel for accused/applicant seeks permission to withdraw this anticipatory bail application with liberty to file afresh before the Court of Sessions after service of the pre-arrest notice. 6.
It is specifically directed that prior to his arrest, the accused/applicant shall be given at least ten days notice in advance so that he may approach the Court of Sessions for anticipatory bail. 7. Accordingly with above observations, the anticipatory bail application is dismissed as withdrawn with liberty as sought. However, the accused/applicant shall join investigation as and when directed in writing by the IO. GIRISH KATHPALIA, J SEPTEMBER 28, 2026/as
