Das, ASC CORAM: MR. JUSTICE R.K. PATTANAIK Order No. ORDER 30.03.2026 03. 1. Heard learned counsel for the petitioners and State. 2. Instant petition has been filed under Section 482 BNSS by the petitioners seeking pre-arrest bail in connection with Keonjhar Town P.S. Case No.90 of 2026 corresponding to G.R. Case No.161 of 2026 pending in the court of learned S.D.J.M.,Keonjhar on the grounds stated. 3. It is informed to the Court by learned counsel for the State that there is compliance of Section 35(3) BNSS in respect of petitioner Nos.2, 3 and 5 and in view of the above, there is no apprehension of their arrest by the local police. Mr. Sahoo, learned counsel for the petitioner submits that the alleged incident took place when the petitioners went to affix a notice on the door of the informant’ residence and while claim so, he refers to a copy of the show cause notice at Annexure-2. Recorded the submission of learned counsel for the State. It is informed to the Court by learned ASC that petitioner No.1 has assaulted informant’s aunt and she received stitched wounds. Mr. Sahoo, learned counsel for the petitioners submits that there is no reference of any such assault in the FIR. Considering the above facts and circumstances under which the alleged incident took place at a time while serving a notice on the informant allegedly in connection with misappropriation of an SHG, this Court though not inclined to grant pre-arrest bail to petitioner Nos.1 and 4, however, is of the view that they should surrender before the learned court below for being released with conditions. 4. Accordingly, it is ordered. 5. In the result, the ABLAPL is disposed of with the direction as aforesaid. It is directed that in the event, petitioner Nos.1 and 4 surrender before the learned S.D.J.M., Keonjhar in connection with Keonjhar Town P.S. Case No.90 of 2026 corresponding to G.R. Case No.161 of 2026 within a fortnight from today, they shall be released on bail upon furnishing a bail bond of Rs.30,000/-(rupees thirty thousand) each with one solvent surety for the like amount each. As there is compliance of Section 35(3) BNSS, it is further directed that the ABLAPL stands disposed of and dismissed against petitioner Nos.2, 3 and 5 for being infructuous. 6.
