This petition has been preferred by the petitioner under Article 226 of the Constitution of India, seeking following reliefs:- “10.1 That, the Hon’ble Court be pleased to call the entire record pertaining to the case of petitioner from the respondent for kind perusal. 10.2 That, the Hon’ble Court by issuing appropriate writ set aside the impugned order dated 05.01.2023 (Annexure-P/1) passed by the DEEPTI JHA Digitally signed by DEEPTI JHA 2 respondent No.1. 10.3 That, the Hon’ble Court by issuing appropriate writ quash / set-aside the intimation letter dated 05.01.2023 along with charge sheet and further all consequences arising thereof against the petitioner. 10.4 Any other relief or relief(s) which this Hon’ble Court may think proper in view of the facts and circumstances of the case may also kindly be granted.” 3. Learned counsel for the petitioner submits that this writ petition was filed challenging the charge sheet issued against the petitioner dated 05.01.2023 (Annexure-P/1). When the matter came up for hearing on admission before this Court on 02.02.2023, this Court directed that the departmental proceedings may go on, but the final order shall not be passed till the next date of hearing. During pendency of this writ petition, the departmental enquiry was proceeded ahead and as per instructions received from the petitioner, there is no adverse finding recorded against him in the departmental enquiry. He further submits that on account of interim order passed by this Court, the final order in the departmental enquiry could not be passed. Thus, he submits that either the order dated 05.01.2023 may be modified and the respondent may be permitted to pass final order or petitioner may be permitted to withdraw this writ petition with liberty to seek remedy available under the law, if any adverse order is passed in the departmental enquiry carried out against the petitioner. He further submits that, if, any decision is taken in the departmental enquiry by the respondent No.1, the same may be communicated to the petitioner. 4. Learned counsel for the respondents submits that he needs to seek instructions from the client in this regard. 5. I have heard learned counsel for the parties and perused the material available on record. 3 6. Be that as it may, as submitted by the learned counsel for the petitioner that the departmental enquiry has already been concluded and according to his submissions, there is no adverse finding recorded against the petitioner. In fitness of thing, this Court orders that the concerned respondent may pass an appropriate order in the departmental enquiry within reasonable period of time, preferably within a period of 60 days from the date of receipt of copy of this order and communicate the same to the petitioner. If any adverse order is passed against the petitioner, he is at liberty to challenge the same in accordance with law. 7. Interim order dated 02.02.2023 passed by this Court is discharged. 8. With the aforesaid observation and direction, this writ petition stands disposed of. 9. Interlocutory application(s), pending if any, also stands disposed of.
