The petitioner has been made accused in connection with Untari Road P.S. Case No. 15 of 2026 registered for the offence punishable under Sections 115(2), 117(2), 118(2), 126(2), 109, 351(2) and 3/5 of the B.N.S., 2023. Learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner in furtherance of common intention with the co-accused persons attempted to murder brother of the informant – Mahendra Mehta with sharp-edged weapon. It is next submitted that the allegation against the petitioner is false. It is further submitted that for the self-same occurrence, the family member of the petitioner namely Sudama Ram has lodged Untari Raod P.S. Case No. 16 of 2026 against the brother of informant and others. It is next submitted that there was a free fight between the parties and the petitioner had no intention to kill anyone. It is further submitted that the petitioner undertakes that he will co-operate with the trial of the case and will not annoy or disturb the informant or witnesses of the case. It is lastly submitted that the petitioner has no criminal antecedents as mentioned in para-13 and has been in custody since 08.06.2026 as mentioned in para-15 of the bail application. Hence, it is submitted that the petitioner be released on bail. Learned A.P.P. opposes the prayer for bail. Considering the facts of this case, the above-named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Palamau at Daltonganj in connection with Untari Road P.S. Case No. 15 of 2026 with the condition that he will co-operate with the trial of the case and furnish his mobile number and photocopy of the Aadhar Card in the court below with an undertaking that he will not change his mobile number during the trial of the case and will not annoy or disturb the informant or witnesses of the case in any manner during the trial of the case.
