This MCC has been preferred by applicants for restoration of Writ Petition (227) No.824/2012, which was dismissed by this Court vide order dated 08.10.2015 for want of prosecution. 3 3. Learned counsel for the applicants submits that the Writ Petition (227) No.824/2012 was listed for final hearing on 05.10.2015; however, the matter could not be reached and, therefore, was not taken up on that date. Subsequently, the matter was taken up for hearing on 08.10.2015. Since the counsel for the applicants was under the impression that the case has not been reached and would be listed before another Bench, she could not appear on 08.10.2015, as a result of which the petition was dismissed for want of prosecution. She further submits that after dismissal of the petition, the applicants remained under the impression that the case would be listed subsequently; however, when the matter was not listed, the applicants made inquiries on 09.06.2021 and came to know that the case had already been dismissed on 08.10.2015. Thereafter, after verification, the present MCC was filed immediately on 11.06.2021. Hence, she prays that the instant MCC may be allowed. 4. Learned counsel for the respondents raised formal objections. 5. On due consideration and for the reasons mentioned in the application, which is well-supported by an affidavit, the present MCC is allowed. 6. The Registry is directed to restore WP227 No.824/2012 (Jairam and Ors. Vs. Mohd. Mumtaj and Ors.) in its original number. 7.
