1. Though the matter is listed on default, counsel for the petitioner submits he has already rectified it. 2. Learned counsel for the petitioner submits the land in question bears Khasra No.74/1, admeasuring area 0.700 hectare was earlier possessed by the grandfather of the Petitioner No.2. After his demise, the petitioners are in possession of the same upon which they have constructed residential house and boundary wall. 2 are in possession of the land since last 40 years. He submits that petitioners has filed an application for grant of patta/lease in respect of the land in question, however, vide impugned order dated 17.03.2026 passed by the Additional Tehsildar, Ambikapur -2, petitioners have been directed to remove the illegal encroachment made by them. He submits that against the order dated 17.03.2026, he has to file an appeal before the concerned Sub-Divisional Officer, however, since there is threat of demolition and dispossession of the petitioner from the property in question, interim protection may be granted to the petitoner till the proceedings before the SDO is concluded. 3. Considering the facts and circumstances of the case, keeping in view the limited prayer of the petitioner, this Writ Petition is disposed of with a direction to the petitioner to file appropriate appeal before the SDO against the impugned order within a period of 15 days from today.
In the eventuality of such an appeal being filed, the concerned SDO is directed to consider and decide the same within a further period of 45 days, in accordance with law. 4. Till the proceedings before the SDO in appeal filed by the petitioner is concluded, respondent authorities are directed not to take any coercive steps against the petitioner. Sd/-
