Heard Mr. Arvind Prajapati, learned counsel for the appellant and learned A.P.P. for the State. 2. This appeal is directed against the order dated 25.05.2026 passed in M.C.A. No. 960 of 2026, arising out of Daltonganj Sadar P.S. Case No. 08 of 2026, by the learned Additional Sessions Judge-II, Palamau at Daltonganj, whereby and whereunder the prayer for bail of the appellant has been rejected. 3. It has been alleged that several miscreants who had gathered and were planning to commit an offence were apprehended by the police and arms, ammunitions and other incriminating materials were recovered from their possession. 4. Submission has been advanced by the learned counsel for the appellant that so far as the appellant is concerned, a country made pistol and three live cartridges were recovered. It has been submitted that in similar circumstances one of the co-accused, namely Avinash Giri @ Avinash Kumar Giri has been granted bail in Cr. A. (DB) No. 371 of 2026. Learned counsel adds that the appellant is in custody 2026:JHHC:20297-DB 2 Cr. A. (DB) No. 753 of 2026 since 27.01.2026. 5. Learned A.P.P. has opposed the prayer for bail of the appellant. 6. Regard being had to the fact that one of the co-accused has been granted bail as noted above and period of custody undergone by the appellant, we while setting aside the order dated 25.05.2026 passed in M.C.A. No. 960 of 2026, arising out of Daltonganj Sadar P.S. Case No. 08 of 2026, by the learned Additional Sessions Judge-II, Palamau at Daltonganj, direct that the appellant be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-II, Palamau, in S.T.
