Mohan Rami Reddy, learned Counsel for the Writ Petitioner and Sri Gudapati Lakshmi Narayana, learned Standing Counsel for Municipalities for Rayalaseema, Nellore and Prakasam Districts. 2. The present Writ Petition is filed seeking a Mandamus to declare the action of the Respondent No.2 in threatening to dispossess the Writ Petitioner from her lawful possession in respect of the vacant site admeasuring 19’ x 30’ situated in Sy.No.232 of 33rd Ward, S.T Colony, Project Street, Srikalahasti Municipality, Chittoor District without issuing any notice. 3. It transpires from the Docket that this Court has not granted any Interim Order. Counter Affidavit has been filed by the Respondent No.2 on 24.01.2024. Para No.4 of the Counter Affidavit of Respondent No.2 indicates that neither the Respondent No.2 nor its subordinates went to the Writ Petitioner’s premises on 10.07.2014 and that the subordinates of Respondent No.2 have never threatened the Writ Petitioner and that the facts pleaded by the Writ Petitioner are false. 4. Having so noted and having regard to the fact that this Writ Petition is filed in the year 2014 and there is no Interim Order subsisting and that the Respondent No.2 had filed the Counter Affidavit as recently as on 24.01.2024 stating that the subordinates of Respondent No.2 have not interfered with the possession, this Court is of the view that no cause survives in this Writ Petition. Accordingly, this Writ Petition is closed. However, the Writ Petitioner is at liberty to approach this Court in the event the Respondents initiate any coercive action in the future. No Order as to Costs 5.
