JUSTICE D K SINGH) The present review petition has been filed seeking review of the Judgment and order dated 10.03.2023 passed by Division Bench of this Court in RERA appeal No.12/2022. 2. This Court has answered the question in respect of the mandate as provided under Section 43(5) and - 3 - HC-KAR NC: 2026:KHC:26848-DB RP No. 123 of 2023 proviso thereto of the RERA Act for depositing 70% of the amount awarded by the Adjudicating Officer for maintaining the appeal before the RERA Appellate Authority. This Court has answered the said question against the review petitioner in the light of Judgment of the Supreme Court in the case of Newtech Promoters and Developers Pvt. Ltd., Vs State of UP and others reported in 2021 SCC Online SC 1044. 3. Learned counsel for the review petitioner wants to reargue the matter. That cannot be the scope of a review petition. 4. Review petition can be entertained only where there is an error apparent on the face of the record either of fact or law. When the question has been answered by the Court after considering the submissions there cannot be an error apparent on the face of the record.
