…...... 09/ 25.03.2026: This bail application has been filed under Sections 483 & 484 of BNSS, 2023 wherein, prayer has been made for grant of bail as he is in custody for allegedly committing offence punishable under Sections 302, 34 of IPC.
2. No one appears on behalf of the petitioner.
3. Heard, learned counsel for the State and have also gone through the impugned order.
4. Learned AddI. P.P. opposes the prayer for bail.
5. It is alleged that this petitioner along with the accused persons came to informant’s house and forcibly took her husband outside. It is further alleged that the accused persons along with this petitioner had earlier committed rape upon her daughter, for which she had lodged a case which was still pending. The accused persons after release from jail were pressuring her and her husband to compromise the case and when they did not yield, accused persons in retaliation committed murder of her husband and hanged him.
6. There is direct allegation against this petitioner that he was threatening the deceased and his family to withdraw the case lodged against this petitioner and others for rape of his daughter. The petitioner thereafter, assaulted the deceased and committed murder, after forcibly taking him from his house.
7. Since there is direct allegation against this petitioner, I am not
inclined to grant privilege of bail to the petitioner. Accordingly, the prayer for bail of the petitioner in connection with Tarhasi P.S. Case No.30 of 2018, Corresponding to G.R. Case No.925 of 2018 (Sessions Trial No.261C of 2019), pending in the Court of learned Additional Sessions Judge-II at Daltonganj, stands rejected.
8. Accordingly, this bail application is dismissed.
