Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased topleased to issue a writ of mandamus or any other appropriate writ order or direction declaring the action of the notice issued by the 5th respondent in directing the petitioner to produce the documents and also appear before the land on 17.03.2026 so as to conduct survey for the purpose of creation of Rastha is illegal, arbitrary and consequently to direct the respondents not to interfere or create/invent any rastha in respect of petitioner's land in Sy.No.93-2 to an extent of Ac.No.3.18 cents situated at Gugudu Village, Narpala Mandal, Ananthapuramu District IA NO: 1 OF 2026 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased pleased to stay of all further proceedings in pursuant to the notice issued by the 5th respondent for proposing of conducting of survey scheduled on 17.03.2026 for the purpose of creating of Rastha by restraining from interfere or create/invent any rastha in respect of petitioner’s land in Sy.No.93-2 to an extent of Ac.No.3.18 cents situated at Gugudu Village, Narpala Mandal, Ananthapuramu District pending disposal of the writ petition Counsel for the Petitioner:

The Court made the following Order:
Heard the learned counsel for the petitioner, the learned Assistant Government Pleader for the respondent Nos.1 to 5 and the learned counsel appearing for the 6th respondent. 2. This writ petition is filed questioning the notice issued by the 5th respondent for the representation of the 6th respondent herein to conduct survey of the subject land as detailed therein. 3. The learned counsel for the petitioner submits that, the 6th respondent is trying to cause survey by the respondent Nos.4 & 5 to create a rastha which is not there on the ground. 4. On the other hand, the learned counsel appearing for the 6th respondent submits that the 6th respondent gave representation to conduct survey and fix boundaries for their land. 5. The learned Assistant Government Pleader relying upon the instructions of the 4th respondent dated 05.05.2026 submits that the revenue records clearly show vanka poramboke and existing road (Ac.1.08). The proposed survey is only for demarcation and verification of government land and existing pathway. There is no proposal to create any new road as alleged by the petitioner. The road portion has not been in active use for the past 4 years and is covered with vegetation. Recently, the petitioner himself has leveled a portion of the road approximately 30 meters and planted mango saplings, thereby

encroached the government land. The petitioner is not at all the absolute owner of the land. There exists road/ vanka poramboke in records. The proposed survey of the land is only to fix boundaries in Sy.No.93-2 to an extent of Ac.3-18 by knowing the ground realities and to protect the rastha occupied by the writ petitioner and to take suitable action in the matter. 6. In view of the above said facts and circumstances and recording the said written instructions of the 4th respondent dated 05.05.2026, the respondent Nos.4 & 5 shall complete the conducting of survey and drawing of final report thereupon pursuant to the notice issued afresh within a period four (4) weeks from the date of receipt of this order giving opportunity to the petitioner and the 6th respondent to participate in the said survey.
Upon consideration of the documents furnished by the petitioner and the 6th respondent, upon verification of the records and conducting survey of the subject land, appropriate decision shall be taken on its own merits as expeditiously as possible, preferably within a period of three (3) months thereafter. The copy of the survey report shall be furnished to the parties concerned specifically to the petitioner and as well as the unofficial respondent. Basing upon the outcome of the report of the survey, appropriate action can be initiated in accordance with law by the authorities concerned. 5
7. Accordingly, the writ petition is disposed of. The written instructions of the 4th respondent dated 05.05.2026 shall be made as part of the court record. Interim order, if any, deemed to have been vacated. There shall be no order as to costs.
