The instant bail application under Section 483 of BNSS has been filed on behalf of the petitioners, who are in custody in connection with FIR No.07/2025 registered at Police Station Christianganj, District Ajmer for the offences punishable under Sections 318(4), 316(2), 61(2)(a) & 351(2) of the BNS, 2023. 2. Learned counsel for the accused-applicants submits that the accused-applicants have falsely been implicated in this matter. He submits that as per the averments made in the FIR, there is a property dispute between the parties. It is submitted that the alleged offences are triable by Magistrate for which maximum punishment is seven years. Trial will take considerable time in its [2026:RJ-JP:4424] (2 of 3) [CRLMB-15207/2025] conclusion. Petitioners are in custody since their date of arrest and there are no criminal antecedents against them. Further custody of the petitioners would not serve any fruitful purpose. 3. On the other hand, learned Public Prosecutor assisted by learned counsel for the complainant vehemently opposes the bail application. Learned counsel for the complainant submits that complainant of this case is a widow lady whose property has wrongly been possessed by the petitioner. 4. Heard learned counsel for the parties and also perused the material available on record. 5. Having regard to the facts and circumstances of the case and considering the fact that alleged offences are triable by Magistrate for which maximum term of sentence is seven years and trial will take long time to conclude as well as looking to the custody period, but without expressing any opinion on the merits/demerits of the case, this Court deems it proper to allow the bail application filed by the accused-applicants. 6. This bail application is accordingly allowed and it is directed that accused-petitioners- 1) Manish Singh Panwar @ Vijay Singh Panwar & 2) Sonu Panwar, D/o Ramchandra Panwar shall be released on bail provided each of them furnishes a personal bond in the sum of Rs.1,00,000/- (Rupees One Lakh only) together with two sureties in the sum of Rs.50,000/- (Rupees Fifty Thousand only) each to the satisfaction of the learned trial Court with the stipulation that they shall appear before that Court and any court to which the matter is transferred, [2026:RJ-JP:4424] (3 of 3) [CRLMB-15207/2025] on all subsequent dates of hearing and as and when called upon to do so. 7. The observations made hereinabove are only for decision of the bail application and would not have any impact on the trial of the case in any manner. (ANIL KUMAR UPMAN),J GAUTAM JAIN /49
