Accused Nos.9 and 10 in Crime No.51/2026 registered by the Adugodi Police Station for the offences punishable under Sections 54, 118(2), 119(1), 127(2), 140(1), 351(2), 352, 3(5) of BNS, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the petitioner and the learned HCGP for the respondent - State. 3. FIR in Crime No.51/2026 was registered by Adugodi Police Station for the aforesaid offences against Ashi @ Ashirvada and others based on the first information dated 11.02.2026 received from Anish T. A, who is alleged victim in the present case. During the course of investigation, petitioners herein were arrested on 23.02.2026 and subsequently remanded to Judicial Custody. They were shown as accused - 3 - HC-KAR NC: 2026:KHC:27372 CRL.P No. 4461 of 2026 Nos.9 and 10 in their remand application. Their bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.2059/2026 was rejected on 06.03.2026. Therefore, they are before this Court. 4. Learned counsel for the petitioners submits that petitioners do not have any criminal antecedents. Accused Nos.2 and 5 against whom similar allegations are found have been enlarged on the bail by the Co-ordinate Bench of this Court in Crl.P.No.4302/2026 and Crl.P.No.4118/2026. Investigation of the case is now completed. Accordingly, prays to allow the petition. 5. Per contra, learned HCGP, who has opposed the petition, does not dispute the submission made by learned counsel for the petitioner. 6. The material on the record would reveal that first informant and accused No.1 were acquainted with each other and accused No.1 allegedly had borrowed hand loan of Rs.2,50,000/- from the first informant but had not repaid the same. When the first informant had demanded repayment, accused No.1 allegedly threatened him and therefore, a - 4 - HC-KAR NC: 2026:KHC:27372 CRL.P No. 4461 of 2026 criminal case was registered against accused No.1 in Tamil Nadu. 7. In the first information, it is further averred that first informant intended to sell his car and for the said purpose, accused No.1 allegedly introduced the petitioner to the first informant. On 09.02.2026, the first informant allegedly accompanied petitioner No.2 to a garage for the purpose of inspection of the vehicle. Petitioner No.2 allegedly took the first informant to a house and after locking the door from outside, the other accused persons allegedly assaulted the first informant with a cricket bat and wicket and also criminally intimidated him and left his place after robbing his gold chain, ring and cash of Rs.30,000/-. 8. Accused Nos.2 and 5 have been granted regular bail by a co-ordinate Bench of this Court in Crl.P.No.4302/2026 and Crl.P.No.4118/2026 disposed of on 08.04.2026. Undisputedly, petitioners do not have any criminal antecedents. Investigation of the case is now completed and charge sheet is filed. - 5 - HC-KAR NC: 2026:KHC:27372 CRL.P No. 4461 of 2026 9. Under the circumstances, I am of the opinion that the prayer made by the petitioners for grant of regular bail needs to be answered affirmatively. Accordingly, the following:- 10. The petition is allowed. The petitioners are directed to be enlarged on bail in Crime No.51/2026 registered by the Adugodi Police Station for the offences punishable under Sections 54, 118(2), 119(1), 127(2), 140(1), 351(2), 352, 3(5) of BNS, subject to the following conditions: a) Petitioners shall execute a personal bond for a sum of Rs.50,000/- each with two sureties each for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioners shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioners shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioners shall not involve in similar offences in future; - 6 - HC-KAR NC: 2026:KHC:27372 CRL.P No. 4461 of 2026 e) The petitioners shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
