ORDER The present writ petition has been filed for the following relief:-
“Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of CERTIORARIFIED MANDAMUS to call for the records relating to the impugned
order dated 31.12.2025 by the 1st respondent in R.C.No. 37/12/B11/RMD and quash the same and consequently direct the 1st respondent to conduct the fresh enquiry in the light of the objections made by the petitioner in his representations dated 01.07.2024 and 22.07.2024 and pass such other or further orders as this Honble Court may deem fit and proper in the circumstances of this case and thus render justice.” 2 https://www.mhc.tn.gov.in/judis

2. Heard Mr.S.Sivathilakar, learned counsel appearing for the petitioner and Mr.S.A.Ajmal Khan, learned Standing Counsel, who takes notice on behalf of the respondents.
3. Upon hearing the learned counsel for the petitioner and perusing the material records of the case, the grievance of the petitioner appears to be twofold. Firstly, with reference to the election of office bearers, the petitioner claims that he is entitled to a hereditary office and that the current office bearers were selected without considering his claim. If the petitioner is aggrieved by the wrongful election of the office bearers, it is open for him to challenge the election.
4. Secondly, with reference to the appointment of a teacher, the Chief Executive Officer, Tamil Nadu Wakf Board has found that the father of the teacher was not part of the committee that selected the teacher. Therefore, with respect to the jurisdiction of the Wakf Board, Wakf Board found no merit in the petitioner’s representation. W.P(MD)No.9150 of 2026 the appropriate legal process. In any event, the Wakf Board, after reviewing the Chief Executive Officer's order, has rightly considered the relevant issues and rejected the representation.
5. Therefore, the petitioner is granted liberty to file an appropriate application before the Tribunal. If he is aggrieved by the election process, the prayer in the writ petition to interfere with the impugned
order cannot be sustained.
