THIS PETITION, COMING ON FOR ADMISSION, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE M.NAGAPRASANNA ORAL ORDER Petitioner – accused No.2 is before this Court calling in question the entire proceedings in C.C.No.151/2018, pending before the Senior Civil Judge and JMFC, T. Narsipura, for the offences under Sections 417, 418, 419, 465, 468, 471, 420 r/w. 34 of the IPC. - 3 - HC-KAR NC: 2026:KHC:26582 CRL.P No. 6725 of 2026 2. Learned counsel for the petitioner and respondent No.2 would in unison submit that during the subsistence of the proceedings, the parties to the lis have entered into settlement amongst themselves by drawing up certain terms and conditions and seek permission to compound the offences. Respondent No.2 – complainant has filed an affidavit before this Court to that effect. 3. The affidavit reads as follows: “AFFIDAVIT “I, SRI. MAHADEVASWAMY, S/o. LATE. MAHADEVAPPA, AGED ABOUT 57 YEARS, BOPPEGOWDANAPURA, B.G.PURA HOBLI, MALAVALLI TALUK, MANDYA- 571 417, today at Bengaluru, the Respondent No. 2 in the above case, do hereby state on oath & solemn affirmation as under. 1. I state that, the petitioner herein is arrayed as Accused No. 2 in CC No. 151/2018 registered by T. Narsipura Police Station for the offences punishable under section 417, 418, 419, 465, 468, 471, 420 R/w 34 of IPC, 1860, on the file of Hon'ble Senior Civil Judge & JMFC, т. Narsipura. 2. I state that, my father filed a private complaint before the Hon'ble Senior Civil Judge & JMFC, T. Narsipura in PCR No. 58/2015 alleging that his grandfather Madappa had two sons, first son was his father Ningarajappa, who married Channajamma and had a son named Mahadevappa, i.e., the Complainant. The second son of the Complainant's grandfather was also named Madappa, who was unmarried and died about 60 years ago. 3. I state that, it was further alleged that the land measuring 2 acres 25 guntas in Survey No. 137/2 of Madavadi village, Talakadu Hobli, Holesalu Grama Panchayat, T. Narsipura - 4 - HC-KAR NC: 2026:KHC:26582 CRL.P No. 6725 of 2026 Taluk, Mysore District, is bounded on East by: Malathi's land in Sy. No. 93/3B, West by: K. Nandakumar’s land, North by: J. Raju's land, South by: Government land was the ancestral property of the Complainant's grandfather, Madappa, and during the life of Madappa, the land was in his possession and after his death, his sons Ningarajappa and Madappa, the present complainant and his wife and children are in possession. The complainant further alleged that on date: 16-04-2007, the Accused No. 1 Impersonating Madappa, has executed the sale deed in favor of Accused No. 2 selling property measuring 2 acres 25 guntas in Survey No. 137/2 and the person who has executed the sale deed, has no right or possession over the above property. 4. I state that, after hearing the complainant in PCR No. 58/2015, by order dated 14/08/2015 passed by Hon'ble Senior Civil Judge & JMFC, T. Narsipura, the complaint was referred to T. Narsipura Police to Investigate and submit report and in compliance of the said order the FIR in Crime No. 362/2015 was registered by T. Narsipura Police Station for offences punishable under sections 417, 418, 419, 465, 468, 471, 420 R/w 34 of IPC. 5. I state that, the defacto complainant died on 14/09/2016 and subsequently on 02/04/2018 the Respondent No. 1 police filed chargesheet against the Petitioner/Accused No. 2 & others for offenses punishable under section 417, 418, 419, 465, 468, 471, 420 R/w 34 of IPC. 6. I state that, the dispute between our family & Accused No. 2/Petitioner in the present case is about Land measuring 2 Acres 25 guntas in Sy. No. 137/2 situated in Madavadi village, Talakadu Hobli, Holesalu Grama Panchayat, T. Narsipura Taluk, Mysore District and with the guidance of well-wishers and elders, the LR's of the complainant Mahadevappa, i.e., me & Accused No. 2/Petitioner have compromised & amicably resolved the property dispute between us and in furtherance of the said compromise the LR's of Complainant, i.e., our family has executed a registered relinquishment deed in favor of Accused No. 2/Petitioner on 10/06/2024 relinquishing our rights in Land measuring 2 Acres 25 guntas in Sy. No. 137/2 situated in Madavadi village, Talakadu Hobli, Holesalu Grama Panchayat, T. Narsipura Taluk, Mysore District. - 5 - HC-KAR NC: 2026:KHC:26582 CRL.P No. 6725 of 2026 7. I state that, in view of the above compromise, the LR's of the Complainant, I have no objections to quash the proceedings in CC No. 151/2018 on the file of Hon'ble Senior Civil Judge & JMFC, T. Narsipura, registered by T. Narsipura Police Station for the offences punishable under section 417, 418, 419, 465, 468, 471, 420 R/w 34 of IPC, 1860, against the Accused No. 2/Petitioner.” In the light of the afore-quoted affidavit of respondent No.2, I deem it appropriate to terminate the proceedings against the petitioners, as the dispute and the allegations are between the individuals with regard to a land and not against the State. 4. For the aforesaid reasons, the following: O R D E R (a) The criminal petition is disposed. (b) The proceedings in C.C.No.151/2018, pending before the Senior Civil Judge and JMFC, T.
