JUSTICE PRAVEER BHATNAGAR
Order 20/01/2026
1. The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The accused-petitioner has been arrested in connection with FIR No. 109/2023 registered at Police Station Mandana District Kota Rural for the offences under Sections 420 and 465 of IPC and Section 8/15 of NDPS Act.
2.
Learned counsel for the accused-petitioner submits that the accused-petitioner has been implicated in this case solely on the basis of disclosure statement of co-accused Shamlal. There is no substantive evidence available on the record to indicate the fact that petitioner Hanumanram has directed the other co-accused Shamlal to supply contraband article containing commercial quantity of 237.96KG poppy-straw. It is also contended that the aforesaid quantity of contraband was recovered from abandoned
[2026:RJ-JP:2319] (2 of 4) [CRLMB-15437/2025] vehicle and after investigation co-accused i.e. Shamlal was found in possession of the said vehicle. There is no connectivity of petitioner with the co-accused through mobile or otherwise and mere disclosure statement stating petitioner's name in the alleged crime cannot be read as substantive evidence. The accused- petitioner is in custody since 06.08.2025 and the trial of the case may take considerable time, therefore, the bail application of the accused-petitioner may be allowed.
3. Learned Public Prosecutor has vehemently opposed the bail application and contended that commercial quantity of contraband article i.e. poppystraw has recovered from the possession of accused-petitioner and co-accused Shamlal has named the petitioner. It is also contended that petitioner is a habitual offender and against him 26 criminal cases pertaining to various offences under IPC and NDPS Act were registered, therefore considering the impact of rider imposed under Section 37 of the NDPS Act coupled with the petitioner's criminal antecedents, the bail application of the accused-petitioner deserves to be dismissed.
4. Heard and perused the factual report and material available on record.
5. It is alleged against the petitioner that commercial quantity recovered from the vehicle was to be supplied to the petitioner, however, apart from the disclosure statement of the co-accused Shamlal there are no other substantive evidence available on the record confirming the fact that said contraband articles were to be supplied to petitioner, though there are many criminal cases against the petitioner, however the same cannot be a ground to
[2026:RJ-JP:2319] (3 of 4) [CRLMB-15437/2025] reject the bail application as the petitioner's involvement in the alleged crime is highly doubtful, therefore, considering the above
facts and without commenting anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioner on bail.
6. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Hanumanaram S/o Shri Lunaram, in connection with FIR No. 109/2023 registered at Police Station Mandana District Kota Rural shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing and as and when called upon to do so. The concerned trial Judge shall verify the address and contact details of the sureties through concerned SHO before releasing the accused-petitioners on bail.
7. The accused is also directed to mark his presence on 25th of every month till conclusion of trial before the concerned police station. The SHO of the concerned police station shall send the presence report of the accused petitioner on the same day to the trial court every month. In case of any breach to the above condition, the learned Public Prosecutor shall be free to move the application against the petitioner for cancellation of the bail before the concerned Court.
8. The accused-petitioner is also directed to submit his present address along with the mobile number to the concerned SHO within seven days of release and the concerned SHO shall verify the said address and the mobile number. In case if the petitioner
[2026:RJ-JP:2319] (4 of 4) [CRLMB-15437/2025] changes his address or mobile number, he shall submit the same before the concerned SHO so also before the concerned learned trial court.
9. A copy of this order shall be sent to the concerned SHO for its strict compliance.
