Order 23/01/2026
1. The genesis of the challenge made in the present batch of writ petitions is the initiation of de-affiliation proceedings against the petitioner institutions who are all private Industrial Training Institute (hereinafter referred to as the “ITI”). The basis for initiation of de-affiliation proceedings was the inspections carried out by the respondents, wherein, certain deficiencies were found in the operations and functioning of the said ITIs. The show cause notice issued in pursuance to the said inspections duly mentioned the deficiencies and called for an explanation from the petitioners and even mentioned that if the explanation submitted by the petitioners is found to be unsatisfactory, de-affiliation proceedings would be initiated. Petitioners filed their responses with respect to the deficiencies so pointed out by the respondents and prayed for dropping the de-affiliation proceedings. Thereafter, while on one hand the notification for admission process for the academic session 2025-26 was issued, on the other hand the respondents taking guidance from office order dated 30.05.2025 issued by Directorate General of Training (hereinafter referred to as “the DGT”), Ministry of Skill Development and Enterprise imposed temporary restrictions on the admissions in the petitioner ITIs for the academic session 2025-26. As a consequence to the issuance of the order dated 30.05.2025, the petitioners were denied access to the NCVT-MIS portal for making online admissions, which compelled the petitioners to approach this Court. 3. Though no specific challenge to any order passed by the respondents restricting the petitioner ITIs from undertaking admission for the academic session 2025-26 has been made in the prayer sought by the petitioners, allegations have been levelled in the petitions that there was no occasion for respondents to impose any temporary restriction upon the petitioners for making admissions qua the academic session 2025-26 and the reports of the joint inspections carried out were not served upon the petitioners, however, the respondents submit that the entire exercise has been carried out strictly in accordance with law and more particularly, in terms of the order dated 30.05.2025 which empowers them to impose temporary restriction on admissions in the ITIs in cases where serious violation of norms are found.
The respondents further submit that, as the joint inspection itself denotes that it is an inspection which is jointly carried out by the officials along with the authorities of the ITIs, the submission that
[2026:RJ-JP:3266] (21 of 22) [CW-16381/2025] copies of any of the joint inspection reports were never served upon the petitioners lacks substance. 4.
Learned counsel for the respondents further submits that considering the controversy, the DGT, very recently in its meeting held on 13.11.2025 and 14.11.2025, minutes of which were issued on 23.12.2025 has required the petitioners to submit their responses in order to ensure that due opportunity of hearing is granted before any action is taken and in the event of a response being submitted by the petitioners, the same would be considered very much in accordance with law and without any preconceived notion.
5. The factum of such meeting being held and the petitioners being called upon by the DGT to submit their response is not disputed by the learned counsel for the petitioners and as per the
learned counsel for the petitioners, even few of the ITIs have already submitted their responses to the DGT.

Taking note of the above and as jointly prayed by learned counsel for all the parties, these petitions are disposed of with the following directions: i) Petitioner ITIs will submit a fresh detailed reply/response along with all the relevant supporting documents to the DGT within two weeks from the date of receipt of this order on the official e-mail ID as mentioned in the minutes of meeting held on 13.11.2025 and 14.11.2025, published on 23.12.2025; ii) The DGT on receipt of the same, would duly consider the said reply/response along with the annexed documents, if any, very much in accordance with law and without being influenced by any earlier orders or reports;
[2026:RJ-JP:3266] (22 of 22) [CW-16381/2025] iii) The DGT along with the State authorities would also conduct a joint inspection of each of the petitioner ITIs within a period of four weeks from the date of receipt of respective replies by serving an advance intimation to the petitioner ITIs; iv) Only upon holding of the said joint inspection and considering the reply along with relevant documents submitted by petitioner ITIs, the DGT will arrive at any decision qua the de- affiliation proceedings so initiated by it against the petitioner ITIs; v) The said decision would be taken by the DGT within three weeks of the holding of the joint inspection with respect of the particular petitioner ITI. Needless to say that the DGT will pass a speaking and well reasoned order strictly in accordance with law and the same would be duly served upon each of the petitioner ITIs within one week from the date of passing of the same.
7. With the above directions, all the writ petitions are disposed of.
