2. Prosecution case in brief is that on receiving secret information, the police intercepted certain persons who were allegedly transporting cattle in a cruel manner through forest routes towards Jharkhand. During the raid, some persons allegedly fled from the spot, whereupon the police registered the present crime against the applicant and other co-accused persons for the aforesaid offences. Hence, the bail application.
3. Learned counsel for the applicant would submit that the applicant is innocent and has falsely been implicated in the present case. He further submits that the cattle alleged to have been recovered by the Police were recovered from the joint possession of the co- accused persons and did not belong to the present applicant, only on the basis of suspicion present applicant has been made an accused in the present case. He also submits that the applicant has no criminal antecedent, therefore he prays for grant of anticipatory bail to the applicant.
4. On the other hand, learned State counsel has opposed the prayer for grant of anticipatory bail and submits that the allegation against the applicant is that he was allegedly involved in transporting cattle in a cruel manner through forest routes towards Jharkhand. Therefore, the applicant is not entitled for grant of bail.
