Learned Additional Government Advocate accepts notice for the respondent. 2. The petitioner is before this Court seeking for the following reliefs: “1. Issue a writ in the nature of Mandamus, or any other appropriate writ, order, or direction, directing the Respondent authority to consider and decide upon the - 3 - HC-KAR NC: 2026:KHC:26358 WP No. 12081 of 2026 Petitioner's representation dated 18/02/2026 at Annexure-A in the light of the judgement and decree dated 06/11/2025 passed by the XXXV Addl. City Civil and Sessions Judge, Bengaluru (CCH-36) in OS No.5243/2018 at Annexure-B within a time-frame deemed appropriate by this Hon'ble Court. ii. Pass such other and further orders as this Hon'ble Court may deem fit in the facts and circumstances of the case, including any consequential orders, in the interest of justice and equity.” 3. In a suit filed by the petitioner in O.S.No.5243/2018 connected with O.S.No.6502/2018, the XXXV Additional City Civil and Sessions Judge, Bengaluru (CCH-36), by judgment and decree dated 06.11.2025, declared the Sale Deed dated 27.02.2018 and the Rectification Deed dated 21.03.2018 as null and void, having been vitiated by fraud. Pursuant to the said judgment and decree, the petitioner submitted a representation on 18.02.2026 to the respondent to effect the necessary cancellation. 4. The grievance of the petitioner is that, despite the said judgment and decree and the representation submitted, the Sub-Registrar has not carried out the - 4 - HC-KAR NC: 2026:KHC:26358 WP No. 12081 of 2026 necessary entries, and it is for that reason that the petitioner is before this Court seeking for the aforesaid reliefs. 5. When a judgment has been passed by a Court, it is required of the Government authorities to comply with the said judgment as soon as possible. The judgment has been passed on 06.11.2025 and the same was brought to the notice of the Sub-Registrar on 18.02.2026. For period of nearly four months, the said representation and judgment have not been acted upon. 6. In that background, I pass the following: ORDER i. Writ petition is allowed. ii. Writ of mandamus is issued. The respondent is directed to consider, decide and act upon the petitioner's representation dated 18.02.2026 in terms of the judgment decree dated 06.11.2025 passed by the XXXV Additional City - 5 - HC-KAR NC: 2026:KHC:26358 WP No. 12081 of 2026 Civil and Sessions Judge, Bengaluru (CCH-36), in OS No.5243/2018 within a period of three weeks from the date of receipt of a copy of this order.
