Bail petition filed on behalf of the petitioner- Ashok Pandit, who is in custody since 16.05.2025 in connection Deori P.S. Case No. 36 of 2025 for the offence registered under Sections 103(1), 3(5) of Bhartiya Nyaya Sanhita, 2023 pending in the Court of learned Judicial Magistrate, 1st Class, Giridih, is pressed into motion.
It is submitted by the learned counsel on behalf of the petitioner that the allegation of homicide was found to be false during investigation and charge sheet has been submitted under Section 108 of the BNS i.e. abetment to commit suicide. Petitioner is the husband of the deceased and was earning his livelihood at Kolkata, whereas the incidence took place in his native village in Giridih District. The allegation of abetment is against the sister-in-law and it is said that the petitioner took the side of the family member and not of the deceased.
Learned A.P.P. assisted by the learned counsel on behalf of informant, Mr. Pratik Sen opposed the bail petition. It is submitted that the petitioner has not only abated the offence, but also threatened her with life.
Considering the argument advanced on behalf of the petitioner, the above-named petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/-(Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the Court below.
