Hon’ble Shri Justice Rakesh Mohan Pandey Judgment On Board 07.05.2026 1) By way of this petition, the petitioners have sought following reliefs:- “10.1 That, the Hon'ble Court may kindly be pleased to call entire record pertaining to passing of impugned order dated 20.7.2021 Annexure-P/1. 10.2 The Hon'ble Court may kindly be pleased to pass an appropriate order in favour of petitioners for grant of promotion order to from the Post of Peon to Assistant Grade-III in the office of respondents by considering their joint representation made on 31.8.2021, 6.10.2021 and 10.12.2021 by granting similar relief as been granted in WP(S) No.4213 of 2021 order dated 12.8.2021. 10.3 Any other relief(s) which this Hon’ble Court may deem fit necessary may kindly be passed in the interest of justice.” 2) Learned counsel appearing for the petitioners would submit that juniors to the petitioners have been promoted to the post of Assistant Grade-III, whereas the cases of the petitioners, who are currently working as Peons have not been considered. He would contend that despite various representations made by the petitioners to respondent No.3 on 26.7.2021, 31.8.2021, 4 6.10.2021 and 10.12.2021, no decision has been taken. He would submit that a direction may be issued to respondent No.4 to take an appropriate decision on the said representations. 3) On the other hand, learned counsel for the State would oppose the submissions made by counsel for the petitioners. He would submit that the petitioners have no right to claim promotion and contends that the petition deserves to be dismissed. 4) I have heard learned counsel for the parties and perused the documents placed on record. 5) A perusal of the document would show that the petitioners are working as Peons under the respondents. The order of promotion was passed in favour of Peons working with the Rural Engineering Services, Division Durg on 20.7.2021 whereas, the grievances of the petitioners have not been considered. As it has been alleged that the names of juniors were considered for promotion to the post of Assistant Grade-III over the petitioners, this petition at this juncture is disposed of reserving liberty in favour of the petitioners to make representation(s) before respondent No.3 within a period of 45 days from today and in turn, the said authority is directed to decide the representations, if so made, within a further period of 90 days. 5 6) With the aforesaid observation(s), and direction(s), this petition is disposed of.
