Virender Singh, Judge (Oral) By way of the present application, interim bail has been sought, in case FIR No.133 of 2024, dated 10.11.2024, registered under Sections 20, 25 and 29 of Narcotic Drugs & Psychotropic Substances Act, with Police Station Damtal, District Kangra, H.P. 2. The relief of bail has been sought, on the ground, that the father of the applicant has expired on 18.08.2026. As per the record annexed, with the application, while, deciding Cr.MP(M) No.3316 of 2026, the applicant was ordered to be released on interim bail w.e.f. 05.08.2026 to 1 Whether reporters of Local Papers may be allowed to see the judgment? ( 2026:HHC:35248 ) 20.08.2026, whereas, unfortunately, his father has expired on 18.08.2026. 3. In such situation, more so, whereby, the applicant has lost his father, during the subsistence of his earlier interim bail, the present application is liable to be considered and allowed. Consequently, the application is allowed and the applicant is ordered to be released on interim bail, w.e.f. 21.08.2026 to 07.09.2026, subject to furnishing bail bonds, in the sum of Rs.1,00,000/- with two sureties, in the like amount to the satisfaction of the learned trial Court. This order of release, however, shall be subject to the following conditions:- “a) The applicant shall not tamper with the prosecution evidence nor hamper the investigation of the case in any manner whatsoever. b) The applicant shall not make any inducement, threat or promises to any person acquainted with the facts of the case so as to dissuade them from disclosing such facts to the Court or the Police Officer. c) The applicant shall not leave the territory of India without the prior permission of the Court.” 4. The applicant is directed to surrender, before the jail authorities, on 08.09.2026 positively by 10:00 a.m. 5. Needless to observe that the applicant shall not seek any exemption to appear before the learned trial Court, ( 2026:HHC:35248 ) on the date(s), fixed, if any, in the trial, during the period of interim bail. 6. Any of the observations, made hereinabove, shall not be taken, as an expression of opinion, on the merits of the case, as these observations are confined, only to the disposal of the present bail application. 7. It is made clear that respondent-State is at liberty to move an appropriate application, in case, any of the bail conditions is found violated by the applicant. 8. Registry is directed to forward a soft copy of the bail order to the Superintendent, Lala Lajpat Rai District & Air Correctional Home, Dharamshala, District Kangra, H.P., through e-mail, with a direction to enter the date of grant of interim bail in the e-prison software.
