JUSTICE SANDEEP KUMAR ORAL ORDER 2 23-06-2026 Heard learned counsel for the petitioner and learned A.P.P. for the State. 2. The petitioner seeks regular bail in connection with Digha P.S. Case No. 108 of 2026 registered for the offence under Sections 103(1) and 3(5) of the B.N.S., 2023. 3. As per the prosecution case, the petitioner and co- accused Khalid @ Golu are accused of killing the deceased. The petitioner is said to have caught hold of the deceased and thereafter, Khalid @ Golu is said to have assaulted the deceased, killing him. 4. Learned counsel for the petitioner submits that the petitioner is quite innocent and has not committed any offence. The petitioner is in custody since 07.02.2026 having clean antecedent. Learned A.P.P. for the State has vehemently opposed the prayer for bail and submits it is a case of murder for which bail should be denied. 6. Considering the gravity of offence, I am not inclined to grant bail to the petitioner. 7. Accordingly, this application is dismissed. 8. The petitioner is at liberty to renew his prayer for bail, if the trial is delayed. 9. It is made clear that any observation made herein is prima facie in nature and limited solely for the purpose of adjudication of the present bail application.
