JUSTICE K.MANMADHA RAO ORAL ORDER Heard Ms.Sridevi Dakshinamurthy, learned counsel appearing on behalf of Sri.S.Balakrishnan, learned counsel for the petitioner. 2. This writ petition is filed seeking a direction to the Court of I Additional Principal Judge, Family Court, Bengaluru (hereinafter referred to as the ‘Family Court’) to dispose of M.C.No.5125/2022 which is pending on its file time bound. 3. Learned counsel for the petitioner submits that petitioner is the wife of the respondent. The petitioner filed M.C.No.5125/2022 seeking for dissolution of marriage. When the Family Court had posted the matter for final arguments, at this stage, the respondent filed a memo and I.A Nos.4 and 5 seeking permission of the Court to produce additional evidence on his behalf, file his objections to the main petition and also to re-open the - 3 - HC-KAR NC: 2026:KHC:18950 WP No. 10514 of 2026 case from the stage of cross-examination of PW.1. The Family Court vide order dated 16.03.2026 allowed the applications. 4. The learned counsel further submitted that the respondent is not showing any interest in prosecuting the case and for one or the other reason, the respondent is dragging the proceeding since 2022 and being aggrieved by the same, this writ petition is filed. 4. Record discloses justification in the submission that is made by learned counsel for the petitioner. Therefore, this Court considers desirable to dispose of the writ petition and give directions. Hence, the following: ORDER (i) Writ petition is disposed of. (ii) The Court of I Additional Principal Judge, Family Court, Bengaluru is directed to take all steps for disposal of M.C.No.5125/2022 as expeditiously as possible. - 4 - HC-KAR NC: 2026:KHC:18950 WP No. 10514 of 2026 (iii) This Court is not issuing the notice to the respondent as no adverse orders are passed and disposed of the petition in the interest of both the parties. (iv) As the writ petition is disposed of without notice to respondent, Family Court is directed to serve copy of this order to respondent so as to give notice to respondent, about filing of this petition and its disposal.
