Heard, learned counsel for the petitioner, learned counsel for the State and have also gone through the impugned order. 3. Learned APP opposes the prayer for bail. 4. After hearing the learned counsel for the parties and after going through the record, I find that the girl is aged about 17-18 years and the boy is aged about 22 years. The statement under section 183 of BNSS is on record wherein the girl said that they have entered into sexual relationship out of free will. 5. Considering the said statement that sexual relationship was with their consent, I am inclined to grant bail to the petitioner. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge-cum-Special Judge (POCSO), Simdega in connection with POCSO Case No. 36 2026:JHHC:6254 2 of 2025 arising out of Simdega PS Case No. 113 of 2025 subject to the condition that one of the bailors should be a close relative of the petitioner, having sufficient landed property in his/her own name within the State of Jharkhand. 6.
