During the pendency of the proceedings, the parties to the lis have settled the dispute among themselves and have - 3 - HC-KAR NC: 2026:KHC:26397 CRL.P No. 5016 of 2026 filed a compounding application along with affidavits. The compounding application reads as follows: "APPLICATION UNDER SECTION 320(2) OF THE CODE OF THE CRIMINAL PROCEDURE We, 1. Nilarnab Biswas, S/o Late. Nirmal Kumar Biswas, Residing at No.128/1, 1st Ulsoor Road, Yellappa Garden, Yellappa Chetty Layout, Shivachetti Gardens, Bengaluru 560001; at present R/at. No. 1725, 16th Main, 5th Block, H.B.R. Layout, Bengaluru 560043, and 2. Mounata Biswas, former W/o. Nilarnab Biswas, R/at. No. 204, Suguna Opal, 1st Main, Chinnanna Layout, LR Bande Main Road, Kaval Byrasandra, R.T. Nagar, Bengaluru 560032; at present R/at No. 103, Spark Nest, Chokkanahalli Main Road, Chokkanahalli, Bengaluru - 560064, do hereby solemnly affirm and state on oath as follows:- 1. We affirm that the marriage between both of us was solemnized on 07-03-2007 at Rajlakshmi, Sonarpur, South 24 Paraganas, (Opposite Baikanthapur Vidyapith), Kolkata, West Bengal as per Hindu rites and customs. 2. We affirm that we have appeared before mediation to resolve our disputes in MC No. 5451/2018, which was pending on the file of the Ld. II Addl Principal Judge, Family Court, Bengaluru. During the course of mediation, we have resolved our disputes amicably. The Petitioner has agreed to pay a total sum of Rs. 15,00,000/- to the Respondent No.2 towards the full and final settlement of all claims of maintenance / arrears / permanent alimony of the Respondent No.2 and - 4 - HC-KAR NC: 2026:KHC:26397 CRL.P No. 5016 of 2026 their minor son. The Petitioner has paid an amount of Rs.10,00,000 (Rupees ten lakhs only) to the Respondent No.2 at the time of our divorce in MC 5451/2018. 3. The Respondent No.2 has agreed to withdraw/quash all the cases filed by her against the Petitioner. As per the terms agreed, the Respondent No. 2 has agreed to cooperate for quashing the criminal proceedings pending against the Petitioner in CC 53719/2018, pending on the file of the Ld. XI Additional Chief Judicial Magistrate, Mayo Hall, Bengaluru, subject to the balance payment of Rs.5,00,000 (Rupees five lakhs only) by the Petitioner to the Respondent No.2. 4. In view of the above, the Respondent No. 2 has expressed no objection to quash the entire proceedings in CC 53719/2018, for the offences punishable under section 323, 506, 498A of Indian Penal Code, pending on the file of the Ld. XI Additional Chief Judicial Magistrate, Mayo Hall, Bengaluru. Wherefore, we, the Petitioner and the Respondent No.2 herein, most respectfully pray that this Hon'ble Court may be pleased to allow the application by permitting the Petitioner to compound the offences in the above criminal proceeding, by paying an amount of Rs.5,00,000 (Rupees five lakhs only) in the form of a Demand Draft, to the Respondent No.2, in the interest of justice." 3. In the light of application for compounding being filed along with the affidavit and offences not being against the State, I deem it appropriate to accept the compounding application and terminate the proceedings against this petitioner in the subject petition. - 5 - HC-KAR NC: 2026:KHC:26397 CRL.P No. 5016 of 2026 4. The petitioner/husband hands over a demand draft bearing No.014961 dated 12.03.2026 for a sum of Rs.5,00,000/- to the wife, who is present before the Court and acknowledges the receipt of the said amount. 5. For the aforesaid reasons, the following: ORDER (i) Criminal Petition is disposed. (ii) Proceedings in C.C.No.53719/2018 pending before the XI Additional Chief Metropolitan Magistrate Mayo Hall, Bangalore, stands quashed qua the petitioner.
