For the Respondents: Ms. Menka Raj Chauhan, Deputy Advocate General. ------------------------------------------------------------------------- Jyotsna Rewal Dua, Judge Following order was passed in this contempt petition on 16.06.2026:- “Learned counsel for the petitioner submits that order dated 09.12.2025 passed by respondent No.2 in purported compliance to the judgment dated 13.10.2025 rendered in CWP No.41/2017 (Surjit Singh versus State of H.P and others) is actually in breach of directions issued and observations made therein. That orders impugned in the writ petition had been quashed and set-aside in CWP No. 41/2017 whereas in the consideration order passed by respondent No.2 on 09.12.2025, mention has been made that on account of petitioner’s not filing an appeal before the Divisional Commissioner, no action could be taken at this stage. Learned counsel for the petitioner further inviting attention to para-9 of the judgment dated 13.10.2025 submitted that observations made therein have been completely overlooked by respondent No.2 while passing the order dated 09.12.2025. Notice. Mr. Y.P.S. Dhaulta, learned Additional Advocate General, appears and waives service of notice on behalf of respondents. Reply/compliance affidavit be filed within two weeks. List thereafter.” 1Whether reporters of print and electronic media may be allowed to see the order? Yes. 2 Learned counsel for the petitioner submitted that consideration order passed by the respondent No.2 on 09.12.2025 is contemptuous and not in consonance with letter & spirit of the decision rendered in Surjit Singh versus State of H.P. and others2. 2. Respondents have though filed the compliance affidavit defending the order in question, however, during hearing of the case, learned Deputy Advocate General on the basis of instructions imparted to her submitted that respondents shall consider the matter afresh strictly in consonance with directions issued in Surjit Singh.2 Learned Deputy Advocate General prayed for some reasonable time to decide the matter afresh. Learned Deputy Advocate General further submitted that accordingly the consideration order dated 09.12.2025 be treated as withdrawn. 3. In view of submissions made by learned Deputy Advocate General, present proceedings are closed. Notices issued to the respondents are discharged. Fresh consideration order in consonance with directions issued, in letter & spirit of Surjit Singh2 be now passed within four weeks. Copy of order be communicated to the petitioner.
